Commission Delegated Regulation (EU) 2022/1011 on indirect exposures to clients from derivatives

The European Commission adopted Delegated Regulation (EU) 2022/1011 to supplement Regulation (EU) No 575/2013 by establishing regulatory technical standards for determining indirect exposures to clients arising from derivatives and credit derivatives where the underlying instrument was issued by that client. Institutions must calculate these exposure values based on potential losses or gains from a default of the underlying instrument, applying specific methodologies for options, credit derivatives, and multi-underlying contracts. The regulation mandates that negative indirect exposure values in the non-trading book be set to zero and requires allocation of exposures to identified, separate, or unknown clients according to Delegated Regulation (EU) No 1187/2014. This Regulation entered into force on 18 July 2022.
