Commission Delegated Regulation (EU) 2023/1626 amending penalty mechanisms for settlement fails in cleared transactions

The European Commission amends Delegated Regulation (EU) 2018/1229 by replacing Article 19 to require Central Securities Depositories (CSDs) to calculate, collect, and distribute cash penalties for settlement fails in cleared transactions directly to participants, bypassing Central Counterparties (CCPs). CCPs are authorized to allocate any remaining net penalty amounts to their clearing members and must establish appropriate mechanisms in their rules to facilitate this. The regulation enters into force on the twentieth day following its publication and applies from 2 September 2024, with transitional provisions ensuring that penalties for fails occurring before that date remain subject to the previous rules.
