The European Commission adopted Implementing Regulation (EU) 2023/2083 to establish mandatory data templates that credit institutions must use when selling or transferring non-performing credit exposures in their banking book. The regulation requires institutions to provide granular, machine-readable information on counterparty details, credit agreements, collateral, and repayment history to prospective buyers via secure channels. It excludes specific transactions such as securitizations, derivative contracts, and sales of branches, while allowing for reduced data completeness in cases involving single agreements, syndicated facilities, or non-EU borrowers. The regulation entered into force on 19 October 2023.
