CONASEV Resolution No. 059-2011

HAVING SEEN:

File No. 2011015474, as well as Report No. 441-2011-EF/94.06.2 dated July 13, 2011, submitted by the Autonomous Assets Directorate, with the favorable opinion of the General Management;

CONSIDERING:

That Article 22 of the Norms for the Prevention of Money Laundering and/or Terrorist Financing, approved by CONASEV Resolution No. 087-2006-EF/94.10, established the procedure and requirements for the approval of the request to exclude the obligation to designate a full-time Compliance Officer;

That, by letter presented on May 5, 2011, complemented on May 25 and June 6, 2011, Macrocapitales Sociedad Administradora de Fondos de Inversión S.A. requested CONASEV, with the respective support, the exclusion from the obligation to designate a full-time Compliance Officer;

That, by Letter No. 31506-2011-SBS, received on July 11, 2011, the Deputy Superintendent of the Financial Intelligence Unit of Peru of the Superintendence of Banks, Insurance and Private Pension Fund Administrators granted its conformity to the request made by Macrocapitales Sociedad Administradora de Fondos de Inversión S.A.;

That, after the evaluation carried out on the request submitted by Macrocapitales Sociedad Administradora de Fondos de Inversión S.A., it has been determined that the request meets the necessary requirements that justify not having a full-time Compliance Officer, considering the particular characteristics of its operations, the size of its organization, among others, in accordance with Article 22 of the Norms for the Prevention of Money Laundering and/or Terrorist Financing, approved by CONASEV Resolution No. 087-2006-EF/94.10; and,

Being in accordance with the provisions of paragraph a) of Article 2 of the Unified Text of the Organic Law of CONASEV, approved by Legislative Decree No. 26126, as well as Article 22 of the Norms for the Prevention of Money Laundering and/or Terrorist Financing, approved by CONASEV Resolution No. 087-2006-EF/94.10, and what was agreed upon by the Board of Directors of this Commission in its session of July 18, 2011;

IT IS RESOLVED:

Article 1.- Authorize Macrocapitales Sociedad Administradora de Fondos de Inversión S.A. the exclusion from the obligation to designate a full-time Compliance Officer.

Article 2.- This resolution shall take effect on the day of its notification.

Article 3.- Order the dissemination of this resolution on the CONASEV Securities Market Portal.

Article 4.- Transcribe this resolution to Macrocapitales Sociedad Administradora de Fondos de Inversión S.A. and to the Deputy Superintendent - Financial Intelligence Unit of Peru of the Superintendence of Banks, Insurance and Private Pension Fund Administrators (UIF-Peru).
