CONSENT AGREEMENT AND ORDER

The Commonwealth of Pennsylvania, acting through the Department of Banking and Securities ("Department"), Compliance Office ("Office"), has reviewed the business practices of Jhanti Mortgage Broker Corporation ("JMBC") and its officers, employees, and directors. Based on the results of its review, the Office concludes that JMBC operated in violation of the Mortgage Licensing Act ("MLA") 7 Pa.C.S. § 6101 et seq. The parties to the above-captioned matter, in lieu of litigation, hereby stipulate that the following statements are true and correct in the settlement of the above-captioned matter and, intending to be legally bound, hereby agree to the terms of this Consent Agreement and Order ("Order").

BACKGROUND

  1. The Department is the Commonwealth of Pennsylvania’s administrative agency authorized and empowered to administer and enforce the MLA, 7 Pa.C.S. § 6101 et seq.

  2. The Office is primarily responsible for administering and enforcing the MLA for the Department.

  3. JMBC is licensed as a Mortgage Broker, license no.107699, Nationwide Mortgage Licensing System & Registry ("NMLS") identification no. 2539388.

  4. JMBC’s principal place of business is located at 5 Interplex Drive, Suite 205, Trevose, PA 19053.


Mortgage Call Reports

  1. Section 6135(a)(3) of the MLA states in pertinent part: "A mortgage broker, mortgage lender or mortgage loan correspondent, or a mortgage originator that is required to obtain and maintain its own bond coverage under section 6131(f)(4) (relating to application for license), on a date determined by the department, shall file periodically, as determined by the department, a report with the department or the Nationwide Mortgage Licensing System and Registry, as determined by the department, setting forth such information as the department shall require concerning the first or secondary mortgage loan business conducted by the licensee. Licensees who fail to file the required report at the date required by the department may be subject to a penalty of $100 for each day after the due date until the report is filed." 7 Pa.C.S. § 6135(a)(3).

  2. The 2025 Fourth Quarter Mortgage Call Report ("2025 Q4 MCR") was due no later than February 14, 2026.

  3. JMBC filed the 2025 Q4 MCR after the February 14, 2026, due date.

  4. The 2026 First Quarter Mortgage Call Report ("2026 Q1 MCR") was due no later than May 15, 2026.

  5. JMBC filed the 2026 Q1 MCR after the May 15, 2026, due date.

Authority of the Department

  1. Pursuant to section 6138(a)(4) of the MLA, the Department has the authority to issue orders "as may be necessary for the proper conduct of the mortgage loan business by licensees, the issuance and renewal of licenses and the enforcement of this chapter." 7 Pa.C.S. § 6138(a)(4).

  2. Section 6135(a)(3) of the MLA authorizes the Department to impose a penalty of up to $100 for each day after the due date until the MCR is filed. 7 Pa.C.S. § 6135(a)(3).


VIOLATION

  1. JMBC is in violation of Section 6135(a)(3) of the MLA for failing to complete the 2025 Fourth Quarter MCR and the 2026 First Quarter MCR by their due dates. 7 Pa.C.S. § 6123(a)(7).

RELIEF

  1. Fine. JMBC agrees to pay a fine of two thousand dollars ($2,000). The fine may be paid in five (5) monthly installments of $333.33 and one (1) monthly installment of $333.35, with the first payment due within thirty (30) days of the Effective Date of the Order as defined in paragraph 20 below. The fine payment shall be made through the Department portal at https://www.portal.dobs.pa.gov.

FURTHER PROVISIONS

  1. Consent. JMBC hereby knowingly, willingly, voluntarily and irrevocably consents to the entry of this Order pursuant to the Department's order authority under the MLA and agrees that it understands all of the terms and conditions contained herein. JMBC, by voluntarily entering into this Order, waives any right to a hearing or appeal concerning the terms, conditions and/or penalties set forth in this Order.

  2. Consumer's Rights. This Order shall not limit or impair any consumer's rights under MLA.

  3. Publication. The Department will publish this Order pursuant to its authority in the Department of Banking and Securities Code. 71 P.S. § 733-302.A.(5).

  4. Entire Agreement. This Order contains the whole agreement between the parties. There are no other terms, obligations, covenants, representations, statements, conditions, or otherwise, of any kind whatsoever concerning this Order. This Order may be amended in writing by mutual agreement by the Office and JMBC.

  5. Binding Nature. The Department, JMBC, and all officers, owners, directors, employees, heirs and assigns of JMBC intend to be and are legally bound by the terms of this Order.


  1. Counsel. This Order is entered into by the parties upon full opportunity for legal advice from legal counsel.

  2. Effectiveness. JMBC hereby stipulates and agrees that the Order shall become effective on the date that the Office executes this Order ("Effective Date").

  3. Other Enforcement Action. a. The Department reserves all of its rights, duties, and authority to enforce all statutes, rules and regulations under its jurisdiction against JMBC in the future regarding all matters not resolved by this Order. b. JMBC acknowledges and agrees that this Order is only binding upon the Department and not any other local, state or federal agency, department or office regarding matters within this Order.

  4. Authorization. The parties below are authorized to execute this Order and legally bind their respective parties.

  5. Counterparts. This Order may be executed in separate counterparts and by facsimile or electronic format.

  6. Titles. The titles used to identify the paragraphs of this document are for the convenience of reference only and do not control the interpretation of this document.


WHEREFORE, in consideration of the foregoing, including the recital paragraphs, the Department of Banking and Securities, Compliance Office, and Jhanti Mortgage Broker Corporation, intending to be legally bound, do hereby execute this Consent Agreement and Order.
