COVID-19: Firms’ MiFID II Conduct of Business Obligations

Investment Services Licence Holders are reminded to comply with MiFID II conduct of business and organizational requirements, including acting in the best interests of clients. Firms must maintain adequate product governance arrangements and conduct target market assessments in a proportionate manner, with greater detail for complex instruments. Information disclosure, suitability assessments for advice or portfolio management, and appropriateness assessments for other services must be performed, paying particular attention to the ramifications of COVID-19. Execution-only exemptions for non-complex instruments remain available, provided other governance and information requirements are met.
