CSSF Circular 19/728 — ESMA Guidelines on non-significant benchmarks under the Benchmarks Regulation
This circular transposes ESMA Guidelines on non-significant benchmarks into Luxembourg regulation, applying to benchmark administrators and supervised contributors. It mandates compliance with requirements for oversight functions, input data verification, methodology transparency, and governance controls as specified in Articles 5, 11, 13, and 16 of the Benchmarks Regulation. Competent authorities must notify ESMA of their compliance status within two months of publication, while administrators and contributors are not required to report compliance. The circular enters into force on the day of its publication.
