CSSF Circular 22/792: Application of ESMA Guidelines on Settlement Fails Reporting under CSDR Article 7
The CSSF integrates the ESMA Guidelines on Settlement Fails Reporting under Article 7 of CSDR into its administrative practice and requires all Central Securities Depositories supervised by the CSSF to comply with these guidelines. The document specifies reporting obligations for CSDs regarding the exchange of information on settlement fails, including detailed rules on data scope, valuation methods, and the calculation of fail rates and average durations. This circular enters into force on the day of its publication and applies to all CSDs established in Luxembourg.
