CSSF Circular 24/855: Application of ESMA Guidelines on Transfer of Data between Trade Repositories under EMIR and SFTR

The CSSF integrates the ESMA Guidelines on the transfer of data between Trade Repositories under EMIR and SFTR into its administrative practice and regulatory approach. This circular requires financial and non-financial counterparties to derivatives, for which the CSSF is the competent authority, to comply with these guidelines, including ensuring that Entities Responsible for Reporting apply them. The guidelines establish procedures for the transfer of derivative data between trade repositories, covering voluntary portability and the withdrawal of registration, to ensure reporting without duplication and data continuity. The circular enters into force as of its publication date on 21 March 2024.
