CVM RESOLUTION NO. 49, OF AUGUST 31, 2021

Provides for the authorization for reproduction and use of the CVM's acronym, logo, and slogan.
Revokes CVM Deliberations No. 749, of January 15, 2016, and No. 857, of June 2, 2020.

THE PRESIDENT OF THE SECURITIES AND EXCHANGE COMMISSION OF BRAZIL – CVM makes public that the Collegiate Board, in a meeting held on August 11, 2021, based on the provisions of Art. 4, I, of Law No. 6.385, of December 7, 1976, and considering the provisions of Arts. 124, I and IV, and 191, of Law No. 9.279, of May 14, 1996, and Art. 296, § 1º, III, of the Penal Code, as well as Arts. 5 and 14 of Decree No. 10.139, of November 28, 2019, APPROVED the following Resolution:

CHAPTER I – SCOPE AND PURPOSE

Art. 1 This Resolution provides for the authorization for reproduction and use of the CVM's acronym, logo, and slogan.

Sole Paragraph. For the purposes of this Resolution, the CVM's acronym, logo, and slogan are those defined in the Autarchy's Visual Identity Manual, available on the CVM's page on the worldwide computer network.

CHAPTER II – AUTHORIZATION

Art. 2 Any person or entity wishing to reproduce and use the CVM's acronym, logo, and slogan, except for mention or reproduction in speeches, scientific or literary works, or in any other publication without commercial connotation and without prejudice to its distinctive character, must obtain prior authorization from the CVM, through a request addressed to the General Superintendent, in accordance with the form contained in Annex A to this Resolution.

Art. 3 It is the responsibility of the General Superintendent, after receiving opinions from the Social Communication Advisory – ASC and the Investor Protection and Guidance Superintendence – SOI, to analyze and decide on the request within 5 (five) business days.

§ 1 The authorization for the reproduction and use of the CVM's acronym, logo, and slogan must be granted specifically and under the following terms:

I – in material for the dissemination of events or in publications related to the securities market that aim to guide investors and encourage the formation of savings and their application in securities; II – in material for the dissemination of any other event or in any other publications that, at the CVM's discretion, are related to the institutional principles and functions of this autarchy; or III – on the webpage of the requesting person or entity on the worldwide computer network, for the purpose of serving as an icon that allows redirection to the CVM's Internet page.

§ 2 The authorization must provide for the form of reproduction and use of the acronym, logo, and slogan, and, in the case of item III, must specify the webpage on the worldwide computer network where the icon will be available and the redirection to the CVM's page.

Art. 4 The reproduction and use of the CVM's acronym, logo, and slogan are prohibited:
I – in a manner different from the form and color standards and guidelines specified in the Visual Identity Manual referred to in the sole paragraph of Art. 1 of this Resolution; II – without the authorization provided for in Art. 2 or in a manner different from the authorization granted by the CVM; and III – that may mislead or confuse third parties.

Art. 5 Any person or entity that has failed to comply with the rules of this Resolution is ineligible to obtain authorization for the reproduction and use of the CVM's acronym, logo, and slogan for a period of 24 (twenty-four) months.

Sole Paragraph. The period referred to in the caput may be reduced by decision of the General Superintendent.

Art. 6 Even if the authorization request is approved in accordance with Art. 3 of this Resolution, the requesting person or entity remains responsible for the reproduction or use of the CVM's acronym, logo, and slogan that may, in any way, cause moral and material damage to the CVM or to third parties, as well as constitute an administrative offense or crime.

CHAPTER III – FINAL PROVISIONS

Art. 7 The following are revoked:
I – CVM Deliberation No. 749, of January 15, 2016; II – CVM Deliberation No. 857, of June 2, 2020.

Art. 8 This Resolution enters into force on October 1, 2021.
