Decision on Determining Tariffs for Fees for Services Provided by the Central Bank of Bosnia and Herzegovina

Based on Articles 7, paragraphs b. and f., and Article 70 of the Law on the Central Bank of Bosnia and Herzegovina ("Official Gazette of BiH", nos. 1/97, 29/02, 13/03, 14/03, 9/05, 76/06 and 32/07), the Governing Board of the Central Bank of Bosnia and Herzegovina, at its 1st meeting held on January 27, 2021, adopts

DECISION

on determining the tariff of fees for services provided by the Central Bank of Bosnia and Herzegovina

Article 1.
(Subject)
This Decision determines the tariff of fees for services provided by the Central Bank of Bosnia and Herzegovina (hereinafter: the Central Bank).

Article 2.
(Definitions)
For the purposes of this Decision:
a) Depositor is a legal entity that, based on the law and in accordance with the regulations of the Central Bank, has an open deposit foreign currency or convertible mark account in the books of the Central Bank and with which a contract or other appropriate act defining transactions with the depositor has been concluded, b) Bank is any legal entity that participates in transactions of accepting monetary deposits and other liquid funds based on a banking license issued by the competent body responsible for licensing and supervising banks.

Article 3.
(Form of the fee tariff)
Fees for services charged by the Central Bank are classified into tariff numbers according to the types of services and further into tariff items of services.

Article 4.
(Calculation and collection of fees)
(1) The Central Bank calculates and collects fees for services listed in the Fee Tariff in convertible marks (hereinafter: KM) or in foreign payment instruments, depending on the type of service, in the manner specified for individual tariff items of services in the tariff numbers in the Fee Tariff. (2) In the event of legal or technical impossibility of collecting fees by debiting an account, the Central Bank issues a written notice of the calculated fee with instructions for payment and the deadline for payment of the fee. (3) The Fee Tariff is an integral part of this Decision.

Article 5.
(Waiver of fee collection)
The Governing Board of the Central Bank may, in accordance with the law, adopt a decision to waive the collection of a specific fee determined by this Decision.

Article 6.
(Termination of validity)
With the start of application of this Decision, the Decision on determining the tariff of fees for services provided by the Central Bank of Bosnia and Herzegovina ("Official Gazette of BiH", nos. 9/16, 30/16, 9/17, 88/18 and 84/20) ceases to be valid.

Article 7.
(Entry into force and start of application)
(1) This Decision enters into force on the eighth day from the date of publication in the "Official Gazette of BiH", and will be applied from May 1, 2021.
(2) This Decision will be published in the "Official Gazette of the Federation of BiH", "Official Gazette of the Republika Srpska" and "Official Gazette of the Brčko District of BiH".

Tariff Number 1. - Transactions with depositors

Notes related to Tariff Number 1.
(1) The limit established for services under item number 1.2.2. represents the average daily balance of deposits or KM funds in the depositor's accounting accounts for the last three years increased by 50%. (2) A fee of 0.5% is charged on the amount of funds exceeding the established limits. (3) The Central Bank establishes the limit after the end of the calendar year, no later than January 15 of the current year, applying to the deposit balance starting from January 1 of the current year, and notifies depositors thereof via letter. (4) For depositors who have had no turnover/balance for the last three years, the limit represents the average balance of deposits or KM funds in the depositors' accounting accounts starting from the date/year when the deposit was made, increased by 50%. For the period from the date of deposit payment to the date when the limit is first established or applied, the fee is charged at a rate of 0.5%.

Collection of fees for Tariff Number 1.
(1) Collection of fees from tariff items 1.1., 1.2. and 1.3. is carried out as follows:
a) Fee collection is carried out in KM, on a monthly basis, within ten working days after the end of the month for which the fee was calculated. b) The fee from tariff item 1.2.2.2. does not exclude the fee from tariff item 1.2.2.1. c) The Central Bank collects the fee by debiting one or a maximum of two designated KM accounts of the depositor (accounts designated by the depositor for these purposes) in favor of the Central Bank's account or by payment by the depositor. The amount of the fee from tariff item 1.2.1. represents the KM counter-value of the foreign currency amount of the calculated fee, recalculated according to the average exchange rate of the Central Bank's exchange list on the last day of the calculation period/month. d) Fees are paid to the account of the Central Office of the Central Bank of BiH number: 000 002 00000000 97, and the purpose of the transfer must necessarily state the tariff item number to which the fee/payment relates. e) The fee from tariff item 1.1.2.3. does not exclude fees from tariff items 1.1.2.1. and 1.1.2.2. (2) Collection of fees from tariff item 1.4. is carried out as follows:
a) Fee collection is carried out annually, within 15 days after the end of the calendar year. The fee is collected in foreign payment instruments. b) The Central Bank collects the fee by debiting the foreign currency account for servicing external debt in favor of the Central Bank's account.

Collection of fees from tariff items 2.1. and 2.2. is carried out as follows:
a) Fee collection is carried out on a monthly basis, with a value date of the tenth working day of the current month or the first following working day, if the tenth day of the month is a non-working day. The fee is collected in KM. b) The Central Bank collects the fee by debiting the bank's reserve account in favor of the Central Office of the Central Bank's account. c) The fee from tariff item 2.1.1. does not exclude fees from tariff items 2.1.2. to 2.1.8. For the service under tariff item 2.1.3, the base for calculating the fee under tariff item 2.1.1. is the value/amount of purchase and sale of physical foreign currency expressed in KM.

a) Fee collection is carried out on a monthly basis, with a value date of the tenth working day of the current month or the first following working day, if the tenth day of the month is a non-working day. The fee is collected in KM. b) The Central Bank collects the fee by debiting the bank's reserve account in favor of the Central Office of the Central Bank's account.

(2) Collection of fees from tariff items 4.1.2. and 4.1.4. is carried out in KM or in foreign payment instruments.
