The decision determines that, for partial transfers of assets, rights and liabilities of a bank under resolution, bridge institution or asset management company, set‑off agreements, netting agreements and structured financing agreements meeting the listed conditions are to be regarded as covered under Article 63 paragraph 1 items 3, 4 and 6 of the Bank Resolution Law. It defines “securitization”, “true sale securitization” and “synthetic securitization”, and specifies that in true‑sale securitizations the originator’s roles (e.g., loan servicing, risk protection, liquidity provision) constitute liabilities within the structured finance agreement, while in synthetic securitizations collateral is treated as a right only when attached to sufficiently specified assets. The decision enters into force eight days after publication in the Official Gazette and applies from 13 October 2025.
