Draft ITS on the provision of information for the purpose of resolution plans (EBA-ITS-2018-02)

The draft Implementing Technical Standards establish a revised framework for reporting information to resolution authorities under Article 11(3) of Directive 2014/59/EU, requiring credit institutions and investment firms to submit data using updated templates and a single data point model. The standards mandate annual reporting frequencies, specify reporting levels such as parent or resolution entity levels, and introduce XBRL taxonomies to facilitate automated data collection and quality control. Resolution authorities retain the right to request additional information or apply simplified obligations for institutions with limited systemic impact, with the new framework intended to become operational in 2019 for data collected as of 31 December 2018.

New in this text (89)
  • The new draft pursues three objectives: The revised ITS establish a minimum set of reporting obligations for institutions.
  • The new draft pursues three objectives: They will also respect the right of resolution authorities, recognised in the BRRD, to set simplified reporting obligations for institutions the failure of which would have limited impact on financial stability.
  • - The revised ITS are without prejudice to the right of resolution authorities to set simplified obligations for banks whose failure would have a limited impact on financial markets, on other institutions and on funding conditions.
  • As per the ITS, templates must be collected on annual basis.
  • The following principles have underpinned those choices: - Templates which collect general information on banking groups due to their general nature, should at least be collected at parent level for the entire group.
  • The following principles have underpinned those choices: Therefore at a minimum the information should be provided on a consolidated basis at the level of the parent or, where the resolution entity is different from the parent , on a consolidated basis at the level of the resolution entity (i.e. for the whole resolution group).
  • The following principles have underpinned those choices: - Information necessary to set MREL should also be reported on an individual basis at the level of institutions which are not necessarily covered by the above but are subject to MREL.
  • The following principles have underpinned those choices: - Information on covered deposits, in line with the scope of coverage of the DGSD, should by definition be collected at credit institution level on an individual basis.
  • These data definitions will be stored in a consistent and accessible database.
  • They will have to be complied with when collecting information from banks in the context of the ITS.
  • Once a counterparty is identified as being included in the top ten, then all the liability items and off￾balance sheet items, aggregated by class, for that counterparty, will be reported.
  • Instead, under a new ‘criticality assessment’ template, institutions are now guided in the analysis of their economic functions and are required to document, at least for each Member State in which a group is active, how they came to the conclusion that a function is critical or not.
  • Criticality must be assessed for each Member State in which the group is active.
  • In the subsequent templates, institutions are required to map critical functions and core business line to legal entities in the group.
  • In any event, regardless of these thresholds all entities providing critical functions should report all templates.
  • Frequency of reporting: annual
  • Remittance date: 31 march of year n
  • One template will be reported for the entire group.
  • 2. The requirements are also without prejudice to simplified obligations.
  • Therefore, to the extent an entity has been declared eligible to simplified obligations the RA may go below the minimum
  • The resolution plan has to contain a mapping of the institution’s critical operations and core business lines and a demonstration of how critical functions and core business lines could be legally and economically separated from other functions so as to ensure continuity upon the failure of the institution.
  • Each template will be collected for the entire group, except the ‘criticality assessment’ template which will be reported per geographic area, and at least for each Member state in which the group is active.
  • reported separately at least for each country in which the group is active.
  • The template will be reported once for the whole group.
  • In addition, all entities providing critical functions should be listed.
  • In terms of remittance dates, information under the new framework will have to be submitted, in the first year, by 31 May 2019 at the latest, and from 2020 onwards, by 30 April at the latest.
  • (4) In order to safeguard the quality, consistency and accuracy of data items reported by institutions, the data items should be subject to common validation rules.

Not carried over (39)
  • According to this procedure, resolution authorities shall first request the information they need for the purpose of drawing up resolution plans of institutions from the competent authorities for these institutions.
  • In particular the resolution authorities shall have the power to require, among other information, the information and analysis specified in Section B of the Annex.’
  • In this second case, resolution authorities shall request institutions to provide the information using the forms and templates laid down in Annexes I–XII to these ITS when the necessary information is included in these ITS.
  • To strike the right balance between harmonisation and appropriate level of flexibility, these ITS state that the forms and templates should not be amended by the authorities or the institutions.
  • 4. Where the information required by the resolution authority is included in one of the categories set out in Article 3, the institution shall provide that information to the resolution authority by submitting the appropriate form or template contained in Annexes I to XII, following the instructions set out in Annex XIII.
  • 6. A request of information by the resolution authority to an institution as referred to in paragraph 3 shall: (c) where the requested information is not included in one of the categories of Article 3, or is not covered by any standard form or template set out in the Annexes I to XII, specify the format in which the information shall have to be submitted;
  • The minimum set of standard forms and templates for the provision of information under Article 11 of Directive 2014/59/EU and for the purposes of Article 2(4) and Article 2(6)(b) of this Regulation shall include the following categories:
  • It may provide a breakdown of the information by individual corporate and/or the type of corporation for assets and liabilities.
  • The following examples highlight the shortcomings of this approach: Such information is not included in the ITS, but the resolution authorities are allowed to request it separately.
  • Resolution authorities have the flexibility to decide what information within the templates to request, but are not allowed to amend the format of the templates according to their needs.
  • Thirdly, the forms and templates should include materiality criteria to ensure that only entities relevant from the perspective of resolution and resolution planning should be included in the forms and templates.
  • The BSG also highlighted that some additional information should be captured by the forms and templates, namely: - Information on unsecured deposits, which should be broken down into ‘Corporates’ and ‘SMEs and individual deposits’, since they represent a different class in the liability hierarchy,
  • The BSG also highlighted that some additional information should be captured by the forms and templates, namely: - Information on liabilities which are bail-inable but could be excluded from bail-in.
  • Therefore, the ITS should not include such a modality.
  • Firms should also be able to determine the level of materiality in relation to certain types of information to avoid having to provide information irrelevant for the purpose of resolution planning.
  • The ITS should also provide more clarity on what is understood as the ‘appropriate timeframe’ for the provision of information.
  • The ITS do not explicitly envisage any waivers from the requirement to provide the information requested by the resolution authorities.
  • At the same time, the ITS, in their goal to strike the right balance between harmonisation and flexibility, mandate that the forms and templates cannot be amended but that the resolution authorities can decide what information within them they require.
  • Only where there is no other form of identification it is allowed to say ‘not available’.
  • The responsible person in the management body should only be provided for resolution entities, as this is the relevant level for the resolution plan.
  • Staff members responsible for information on critical functions, shared services, etc., should be provided on other templates dealing with the specific information.
  • Counterparties shall be reported for the relevant Groups of Connected Clients and, if a client does not belong to a Group of Connected Clients, on an individual level.
  • A separate form ought to be provided for liabilities governed by different law: EEA or ‘third country’.
  • Furthermore, a breakdown for deposits of maturities into under/over 1 year has to be provided as this distinction is important for MREL.
  • Deposits governed by third-country law will be reported separately in a sheet on liabilities governed by third-country law.
  • Liabilities excluded under Article 44(2) are reported in column 170.
  • Institutions cannot report liabilities excluded from bail-in under Article 44(3) since they will not know which ones have been excluded.
  • Derivatives should be reported since they are bail￾inable.
  • That is correct – CDs/CPs should be included.
  • The instructions have been amended to state that where the identity of the holder of a security is not known, only totals should be provided.
  • Liabilities to governments, central banks and supranationals should be reported separately and additional rows have been added to the form.
  • Membership requirements are established by the relevant payment or settlement system and should be collected once directly from the relevant system
  • Where an institution filling in the form thinks there is no substitute it should say so.
  • The BIC code should be provided.
  • Where the BIC code is not available, another form of identification shall be provided, e.g. institution code or account number.
  • Only where there is no other form of identification is it allowed to say ‘not available’.
  • The institution should provide an assessment of what would be the consequence of the resolution.
  • The expectation is that firms do not change their systems and suppliers of systems every day, especially not the key ones.
  • For systems with multiple licences, each licence should be provided separately.
