CIRCULAR LETTER OF THE FINANCIAL SERVICES AUTHORITY OF THE REPUBLIC OF INDONESIA NUMBER 11/SEOJK.03/2023
CONCERNING
THE MAXIMUM LIMIT FOR CREDIT GRANTING BY RURAL BANKS AND THE MAXIMUM LIMIT FOR FUND DISBURSEMENT BY SHARIA RURAL BANKS
In view of the establishment of Financial Services Authority Regulation Number 23 of 2022 concerning the Maximum Limit for Credit Granting by Rural Banks and the Maximum Limit for Fund Disbursement by Sharia Financing Banks (State Gazette of the Republic of Indonesia Year 2022 Number 27/OJK, Supplement to the State Gazette of the Republic of Indonesia Number 19/OJK), hereinafter abbreviated as POJK BMPK BPR BMPD BPRS, and in order to align with applicable laws and regulations, it is necessary to regulate the implementation of POJK BMPK BPR BMPD BPRS through this Financial Services Authority Circular as follows:
I. GENERAL PROVISIONS
In this Financial Services Authority Circular, the following terms are defined:
a. Rural Bank (BPR) is a conventional bank type that does not provide services in current account transactions directly. b. Sharia Rural Bank (BPRS) is a Sharia bank type that does not provide services in current account transactions directly.
c. Capital refers to core capital and supplementary capital as referred to in Financial Services Authority Regulations regarding minimum capital adequacy requirements and minimum core capital fulfillment for BPR or BPRS.
d. Interbank Fund Placement for BPR is the investment of funds in other banks in the form of current accounts, savings, time deposits, certificates of deposit, granted Credits, and other similar fund investments. e. Interbank Fund Placement for BPRS is the investment of funds in Sharia commercial banks, Sharia business units, or other BPRS based on Sharia principles in the form of current accounts, savings, deposits, certificates of deposit, granted Financing, and other fund placements in accordance with Sharia principles, as well as in conventional commercial banks in the form of current accounts and/or savings for the purpose of fund transfers for BPRS and BPRS customers. f. Maximum Limit for Credit Granting (BMPK) is the maximum percentage of realized fund provision permitted relative to BPR Capital. g. Maximum Limit for Fund Disbursement (BMPD) is the maximum percentage of realized fund disbursement permitted relative to BPRS Capital. h. Fund Provision is the investment of BPR funds in the form of Credit, and/or Interbank Fund Placement.
i. Fund Disbursement is the investment of BPRS funds in the form of Financing, and/or Interbank Fund Placement.
j. Related Party refers to individuals, companies, or entities that have a controlling relationship with BPR or BPRS, directly or indirectly, through ownership, management, and/or financial relationships. k. Unrelated Party refers to individuals, companies, or entities that do not have a controlling relationship with BPR or BPRS, directly or indirectly, through ownership, management, and/or financial relationships.
l. BMPK or BMPD Violation is the excess difference between the percentage of Fund Provision or Fund Disbursement realized relative to BPR or BPRS Capital and the permitted BMPK or BMPD, using the Capital position of the last month prior to the realization of Fund Provision or Fund Disbursement.
m. BMPK or BMPD Exceedance is the excess difference between the percentage of Fund Provision or Fund Disbursement already realized relative to BPR or BPRS Capital and the permitted BMPK or BMPD as of the report date, excluding BMPK or BMPD Violations.
BPR in providing funds and BPRS in disbursing funds must observe prudence principles, including through the management of BPR Fund Provision and BPRS Fund Disbursement concentration towards individuals, borrower groups, or facility recipient customer groups, so that the risk of Fund Provision or Fund Disbursement is not concentrated on specific individuals, borrower groups, or facility recipient customer groups.
In accordance with Article 23 of POJK BMPK BPR BMPD BPRS, the portion of Fund Provision or Fund Disbursement guaranteed by the Indonesian Government directly or through state-owned enterprises or regional-owned enterprises, which is exempt from BMPK or BMPD calculations, must meet at least the requirement that the guarantee is unconditional and irrevocable. The term "unconditional guarantee" means:
a. the benefits obtained by the BPR providing funds or BPRS disbursing funds from the guarantee do not substantially decrease even if losses occur due to factors beyond the control of BPR or BPRS; and b. it does not contain procedural requirements, including:
II. RELATED PARTIES
In accordance with Article 8 paragraph (2) of POJK BMPK BPR BMPD BPRS, Related Parties consisting of individuals or companies that are controllers of BPR or BPRS, directly or indirectly:
a. own 10% (ten percent) or more of the shares of BPR or BPRS individually or jointly; b. take actions to achieve common goals in controlling BPR or BPRS, with or without a written agreement, so that they jointly control and/or own 10% (ten percent) or more of the shares of BPR or BPRS;
c. have the authority and/or ability to approve, appoint, and/or dismiss members of the Board of Commissioners and/or members of the Board of Directors of BPR or BPRS; and/or
d. have the ability to determine the strategic policies of BPR or BPRS.
A party is considered to have a joint controlling relationship as referred to in:
a. item 1 letter a, if the parties have a family relationship up to the second degree, both horizontal and vertical, as referred to in the explanation of Article 8 paragraph (1) letter d of POJK BMPK BPR BMPD BPRS. b. item 1 letter b, if proven by:
Strategic policies as referred to in item 1 letter d are policies concerning the determination of the direction and objectives of business implementation that have a significant impact.
A party is considered to have a controlling relationship as referred to in item 1 letter c and item 1 letter d if, among others, there are shareholders owning less than 10% (ten percent) and/or non-shareholders who have the authority and/or ability to determine strategic policies, including determining the management of BPR or BPRS.
III. BORROWER GROUPS OR FACILITY RECIPIENT CUSTOMER GROUPS
In accordance with Article 12 of POJK BMPK BPR BMPD BPRS, the determination of borrower groups or facility recipient customer groups can be analyzed based on ownership, management, and/or financial relationships.
In the event that Borrowers or Facility Recipient Customers are married couples without a prenuptial agreement regarding separation of property in accordance with applicable laws and regulations, they are categorized as 1 (one) Borrower or Facility Recipient Customer.
In the event that the collateral provided:
a. is owned by parties under a marital relationship without a prenuptial agreement regarding separation of property in accordance with applicable laws and regulations; and b. is acquired during the marriage, then all Borrowers or Facility Recipient Customers using the aforementioned collateral are categorized into 1 (one) borrower group or facility recipient customer group.
Financial relationships between Borrowers or Facility Recipient Customers in determining borrower groups or facility recipient customer groups as referred to in item 1 are analyzed based on several factors, namely:
a. the existence of financial assistance from 1 (one) Borrower or Facility Recipient Customer to other Borrowers or Facility Recipient Customers with specific requirements that cause the party providing financial assistance to have the authority to determine the strategic policies of the company or entity receiving the financial assistance, including decisions to distribute dividends and/or change management; b. the existence of significant business chain linkages in the business operations of Borrowers or Facility Recipient Customers with other Borrowers or Facility Recipient Customers, resulting in interdependence between Borrowers or Facility Recipient Customers that can be proven to cause:
Example:
In a cooperation between PT “A” and PT “B”, PT “A” sells a significant amount of products produced to PT “B”, where PT “A” is unable to easily transfer the sale of such products to other parties, so that if PT “B” experiences financial problems and cannot buy products from PT “A”, it can cause the cash flow of PT “A” to be disrupted, thereby causing PT “A” to experience difficulties in meeting its obligations. BPR “Z” provides Credit facilities to PT “A” and PT “B”, so that PT “A” and PT “B” are categorized as a borrower group.
In the event that the collateral object is owned by parties different from those receiving the Credit or Financing facilities, and there is written consent from the collateral owner regarding the use of the collateral as a guarantee for such Credit or Financing facilities, then the collateral owner and the recipient of the Credit or Financing facilities are categorized as having a guarantee relationship. Thus, the recipient of such Credit or Financing facilities is calculated as 1 (one) borrower group or facility recipient customer group.
Example:
Mr. “A” and Mr. “B” receive Financing facilities from BPRS “X”. Based on the consent of Mr. “B”, Mr. “A”'s Financing facility uses collateral owned by Mr. “B”. Mr. “A” and Mr. “B” are categorized as having a guarantee relationship and are calculated as a facility recipient customer group in the BMPD calculation.

APPENDIX I
FINANCIAL SERVICES AUTHORITY CIRCULAR LETTER
OF THE REPUBLIC OF INDONESIA
NUMBER 11/SEOJK.03/2023
CONCERNING
THE MAXIMUM LIMIT FOR CREDIT GRANTING BY RURAL BANKS AND THE MAXIMUM LIMIT FOR FUND DISBURSEMENT BY SHARIA RURAL BANKS
I. BMPK CALCULATION
BMPK for Credit
a. BMPK for Credit is calculated based on the debit balance of all Credits received by Borrowers. b. BPR is not permitted to provide Fund Provision utilized by parties other than the Borrower stated in the Credit agreement. In the event of a deviation in Credit granting, such as providing Fund Provision utilized by parties other than the Borrower stated in the Credit agreement, BMPK is calculated based on the debit balance of all Credits received by the party utilizing such Credit.
c. In accordance with Article 3 paragraph (1) of POJK BMPK BPR BMPD BPRS, BPR is prohibited from entering into agreements or setting requirements that obligate BPR to provide Fund Provision that would result in a BMPK violation.
d. In the event that BPR enters into agreements setting payment and withdrawal schemes at any time (withdrawal facilities), BPR must ensure that such schemes will not result in a BMPK violation.
BMPK for Interbank Fund Placement in the Form of Savings and Deposits
The calculation of BMPK for Interbank Fund Placement in the form of savings is based on the savings balance, or in the form of deposits, based on the nominal amount of deposits in the reporting month.
BMPK for Fund Provision to Related Parties
a. The calculation of BMPK for Fund Provision to Related Parties is based on the total amount of Credits to non-banks and Interbank Fund Placement to all other BPR or BPRS that are Related Parties of the BPR. b. BMPK for Fund Provision to Related Parties is 10% (ten percent) of BPR Capital.
BMPK for Interbank Fund Placement in Other Unrelated BPR and/or BPRS
The calculation of BMPK for Interbank Fund Placement in other BPR and BPRS that are Unrelated Parties is based on the total amount of Interbank Fund Placement in each other BPR and/or BPRS Unrelated Party, at a maximum of 20% (twenty percent) of BPR Capital.
BMPK in the Form of Credit to 1 (One) Unrelated Party Borrower
The calculation of BMPK in the form of Credit to each Unrelated Party Borrower is set at a maximum of 20% (twenty percent) of BPR Capital.
BMPK in the Form of Credit to 1 (One) or More Unrelated Party Borrowers Who Are Part of an Unrelated Party Borrower Group
The calculation of BMPK in the form of Credit to 1 (one) or more Unrelated Party Borrowers who are part of an Unrelated Party Borrower Group is calculated based on Credit grants to:
a. each Unrelated Party Borrower at a maximum of 20% (twenty percent) of BPR Capital; and b. 1 (one) Unrelated Party Borrower Group at a maximum of 30% (thirty percent) of BPR Capital.
The term 1 (one) borrower group includes non-bank Borrowers who have management, ownership, and/or financial relationships with the bank as the lender.
BMPK in the Form of Interbank Fund Placement to Mitigate Potential and/or Liquidity Issues of Other BPR and BPRS
The calculation of BMPK in the form of Interbank Fund Placement to mitigate potential and/or liquidity issues is based on all Interbank Fund Placement in the form of savings and/or deposits in other BPR and BPRS, including Related Parties and Unrelated Parties, at a maximum of 30% (thirty percent) of BPR Capital.
BMPK Violations and Exceedances must be calculated in the risk profile and governance assessment that has a significant impact.
In determining the health level value of BPRs in accordance with the Financial Services Authority Regulation regarding the assessment of the health level of rural banks and sharia rural banks.
Interbank fund placement in other BPRs or Sharia Rural Banks (BPRS) is excluded from the BMPK calculation as long as it meets the requirements as referred to in Article 24 of the POJK on BMPK for BPR, BMPD, and BPRS. Example:
There are 28 (twenty-eight) BPRs that have made an agreement to place funds in the form of deposits, contributions, or portions of funds in one designated BPR to coordinate the management of the gathered funds. The agreement includes among others:
a. the amount of deposits, contributions, or portions of funds that must be placed by each BPR in the designated BPR, for example, Rp25,000,000.00 (twenty-five million rupiah) per BPR; and/or b. the maximum amount of funds or liquidity loans that can be placed by the designated BPR to one of the 28 (twenty-eight) BPRs, for example, 10 (ten) times the amount of deposits, contributions, or portions of funds placed, or Rp250,000,000.00 (two hundred fifty million rupiah).
The items excluded from the BMPK calculation in the above example are:
a. each fund placement from the 28 (twenty-eight) BPRs to the designated BPR amounting to Rp25,000,000.00 (twenty-five million rupiah); and b. fund placement from the designated BPR to one of the 28 (twenty-eight) BPRs experiencing liquidity difficulties amounting to Rp250,000,000.00 (two hundred fifty million rupiah).
In the event that before the POJK on BMPK for BPR, BMPD, and BPRS came into effect there were no violations or exceedances of BMPK, and after the POJK came into effect there was an addition of Related Parties resulting in an exceedance of BMPK, the BPR establishes this condition as a status of BMPK exceedance for all Related Parties.
In the event that before the POJK on BMPK for BPR, BMPD, and BPRS came into effect there were violations or exceedances of BMPK by Related Parties, and after the POJK came into effect there was an addition of Related Parties resulting in an exceedance of BMPK for the new Related Parties, then:
a. the BPR establishes the status of BMPK exceedance for the aforementioned new Related Parties; and b. the violations or exceedances of BMPK established by the BPR prior to the implementation of the POJK on BMPK for BPR, BMPD, and BPRS remain as violations or exceedances of BMPK.
II. BMPK VIOLATIONS
A BPR is stated to have committed a BMPK violation in the event that there is an excess difference between the percentage of Fund Provisioning realized against the BPR's Capital and the permitted BMPK, including in the event that the BPR restructures Credit.
The BPR Capital used in the BMPK calculation is the sum of core capital and supplementary capital in accordance with the Financial Services Authority Regulation regarding minimum capital provision requirements and minimum core capital fulfillment for BPRs at the position of the last month before the realization of Fund Provisioning.
A BPR remains assessed as violating BMPK as long as the BMPK violation has not been resolved.
In the event that there is a BMPK violation in the form of Fund Provisioning in the form of Credit to 1 (one) or more Unrelated Party Borrowers that are part of an Unrelated Party Borrower group, the BMPK violation is calculated based on the sum of violations for granting Credit to each Borrower and the violation for granting Credit to 1 (one) group of Unrelated Party Borrowers.
In the event that there is Fund Provisioning to Related Parties in the current month that causes a BMPK violation, the BPR establishes the status of BMPK violation for all Related Parties.
Example of BMPK Violation Calculation for BPR:
a. Fund Provisioning in the form of Credit and Interbank Fund Placement to BPR Related Parties BPR "X" provides Fund Provisioning in the form of Credit to several Borrowers and Interbank Fund Placement to BPR "Y" (Related Party) with the following conditions:
| Name | Fund Provisioning Amount | BMPK | BMPK Violation Nominal | BMPK Violation % |
|---|---|---|---|---|
| A | 200,000,000 | |||
| B | 100,000,000 | |||
| C | 200,000,000 | |||
| BPR "Y" | 200,000,000 | |||
| Total Fund Provisioning A, B, C, and BPR "Y" | 700,000,000 | 600,000,000 | 100,000,000 | 1.67 |
Based on the percentage of Fund Provisioning at realization to Mr. A, Mr. B, Mr. C, and BPR "Y" amounting to Rp700,000,000.00 (seven hundred million rupiah) against BPR Capital in August 2023 position amounting to Rp6,000,000,000.00 (six billion rupiah) minus the Related Party BMPK percentage (10%), the result is as follows:
(Rp700,000,000.00 / Rp6,000,000,000.00 x 100%) – 10% = 1.67%.
Thus, there is a Related Party BMPK violation of 1.67% (one point six seven percent).
b. Fund Provisioning to Unrelated Party Borrowers
c. Fund Provisioning in the form of Credit to 1 (One) or More Unrelated Party Borrowers that are Part of an Unrelated Party Borrower Group
BMPK Violation Calculation
September 2023 Position
| Name | Fund Provisioning Amount | BMPK | BMPK Violation Nominal | BMPK Violation % |
|---|---|---|---|---|
| A | 1,000,000,000 | 2,000,000,000 | ||
| B | 500,000,000 | 2,000,000,000 | ||
| C | 2,100,000,000 | 2,000,000,000 | 100,000,000 | 1 |
| BPR "Y" | 1,500,000,000 + 800,000,000 = 2,300,000,000 | 2,000,000,000 | 300,000,000 | 3 |
| Group "Z" Total Fund Provisioning A, B, C and BPR "Y" | 5,100,000,000 | 3,000,000,000 | 2,100,000,000 | 21 |
a) Individual Borrower BMPK
(1) Based on the percentage of Credit to Mr. C amounting to Rp2,100,000,000.00 (two billion one hundred million rupiah) against BPR Capital in August 2023 position amounting to Rp10,000,000,000.00 (ten billion rupiah) minus the Unrelated Party BMPK percentage (20%), the result is as follows:
(Rp2,100,000,000.00 / Rp10,000,000,000.00 x 100%) – 20% = 1% Thus, there is an Unrelated Party BMPK violation of 1% (one percent).
(2) Based on the percentage of Fund Provisioning to BPR "Y" amounting to Rp2,300,000,000.00 (two billion three hundred million rupiah) against BPR Capital in August 2023 position amounting to Rp10,000,000,000.00 (ten billion rupiah) minus the Unrelated Party BMPK percentage (20%), the result is as follows:
(Rp2,300,000,000.00 / Rp10,000,000,000.00 x 100%) – 20% = 3% Thus, there is an Unrelated Party BMPK violation of 3% (three percent).
(3) Based on the percentage of Credit from BPR "X" to each of Mr. A and Mr. B against BPR Capital in August 2023 position does not exceed the Unrelated Party BMPK percentage. Thus, Credit to Mr. A and Mr. B does not violate Unrelated Party BMPK. b) Borrower Group BMPK Since Mr. A, Mr. B, Mr. C, and BPR "Y" meet the borrower group criteria, the BMPK calculation is also calculated based on Fund Provisioning in the form of Credit to the borrower group amounting to Rp5,100,000,000.00 (five billion one hundred million rupiah). The BMPK for Unrelated Party Borrower Groups is 30% (thirty percent). The calculation for this borrower group BMPK is as follows:
(Rp5,100,000,000.00 / Rp10,000,000,000.00 x 100%) – 30% = 21%.
Thus, there is an Unrelated Party Borrower Group BMPK violation of 21% (twenty-one percent).
BMPK Violation Calculation:
November 2023 Position
| Name | Fund Provisioning Amount | BMPK | BMPK Violation Nominal | BMPK Violation % |
|---|---|---|---|---|
| BPR "Z" | 1,000,000,000 + 1,000,000,000 = 2,000,000,000 | 1,600,000,000 | 400,000,000 | 5 |
| PT A | 1,300,000,000 | 1,600,000,000 | ||
| Borrower Group Total Credit BPR "Z" and PT A | 2,300,000,000 | 2,400,000,000 |
a) Individual Borrower BMPK
(1) Interbank Fund Placement of BPR "Y" in BPR "Z" in the form of a deposit amounting to Rp1,000,000,000.00 (one billion rupiah) and Credit amounting to Rp1,000,000,000.00 (one billion rupiah), so the total Interbank Fund Placement amount is Rp2,000,000,000.00 (two billion rupiah). The BMPK for Interbank Fund Placement in other BPRs is 20% (twenty percent). The calculation for this Interbank Fund Placement BMPK is as follows:
(Rp2,000,000,000.00 / Rp8,000,000,000.00 x 100%) – 20% = 5%.
Thus, there is an Unrelated Party BMPK violation of 5% (five percent).
(2) Based on the percentage of Credit from BPR "Y" to PT A amounting to Rp1,300,000,000.00 (one billion three hundred million rupiah) against BPR Capital in October 2023 position amounting to Rp8,000,000,000.00 (eight billion rupiah) does not exceed the Unrelated Party BMPK percentage. Thus, Credit to PT A does not violate Unrelated Party BMPK. b) Borrower Group BMPK Since PT A and BPR "Z" meet the borrower group criteria, the BMPK calculation is also calculated based on the borrower group. Based on the percentage of the total outstanding Credit to BPR "Z" and PT A amounting to Rp2,300,000,000.00 (two billion three hundred million rupiah) against BPR Capital in October 2023 position amounting to Rp8,000,000,000.00 (eight billion rupiah) does not exceed the Unrelated Party Borrower Group BMPK percentage. Thus, Credit to BPR "Z" and PT A as an Unrelated Party Borrower Group does not violate BMPK.
BMPK Violation Calculation
December 2023 Position a) Individual Borrower BMPK (1) Credit grant from BPR "B" to PT X amounting to Rp1,700,000,000.00 (one billion seven hundred million rupiah) violates BMPK with the following calculation:
(Rp1,700,000,000.00 / Rp7,000,000,000.00 x 100%) – 20% = 4.29%.
(2) Credit grant from BPR "B" to PT Y amounting to Rp1,500,000,000.00 (one billion five hundred million rupiah) violates BMPK with the following calculation:
(Rp1,500,000,000.00 / Rp7,000,000,000.00 x 100%) – 20% = 1.43%. b) Borrower Group BMPK Since PT X and PT Y meet the Unrelated Party Borrower Group criteria, the BMPK calculation is also calculated based on the borrower group amounting to Rp3,200,000,000.00 (three billion two hundred million rupiah) (Rp1,700,000,000.00 + Rp1,500,000,000.00). The BMPK for Unrelated Party Borrower Groups is 30% (thirty percent). The calculation for this borrower group BMPK is as follows:
(Rp3,200,000,000.00 / Rp7,000,000,000.00 x 100%) – 30% = 15.71%.
Based on the calculations above, then:
