EMIR – Intra-group transactions

Intra-group transactions are exempted from the clearing obligation under Article 4(2) of EMIR, provided competent authorities are notified in writing and in good time. Exemptions from margin requirements apply to transactions within the same EEA country, between an EEA and another EEA country, or between an EEA and a non-EEA country under Article 3(2)(d). Additionally, reporting obligations under Article 9 are waived when counterparties are included in the same full consolidation and subject to centralized risk assessment.
