Market operators and data reporting services providers must implement common standards for appointing and assessing management body members, including requirements for sufficient time commitment, knowledge, skills, experience, honesty, integrity, and independence of mind. These entities are required to notify the Commission de Surveillance du Secteur Financier (CSSF) of the identity of all management body members and any changes to their composition, as well as to report any material conflicts of interest and mitigating measures. The guidelines apply from 3 January 2018, with the circular entering into force on the date of the law transposing MiFID II.
