Exemption of Managers of Collective Investment Schemes from certain requirements of section 99(1) of CISCA

The FSCA published for public comment a draft exemption of CIS managers from certain section 99(1) CISCA requirements, under which investors in a targeted portfolio would no longer be actively balloted on an amalgamation; they may instead object, exit or accept. Comments must be submitted on the published Comments Template in Word format by 8 August 2022 to FSCA.RFDStandards@fsca.co.za. The FSCA maintains that section 99 requires both original and targeted scheme investors to be balloted.
