New Regulation 904 establishes exceptions to anti-tying restrictions under Section 929 of the State Banking Code, effective December 11, 2005. The regulation permits banks to vary consideration for products based on combined minimum balances in specified eligible products, provided all deposits are eligible and deposit balances count at least as much as nondeposit products. It also allows transactions with non-US incorporated entities or non-US resident individuals. These exceptions terminate if the Commissioner finds the arrangements result in anti-competitive practices.
