Final Report on Amending Risk-Mitigation Requirements for Non-Centrally Cleared OTC Derivatives Regarding Physically Settled Foreign Exchange Forwards

The European Supervisory Authorities (ESAs) propose draft amendments to Delegated Regulation (EU) 2016/2251, which would revise the risk-mitigation techniques for non-centrally cleared OTC derivative contracts. Specifically, the draft amendments limit the mandatory requirement to exchange variation margin for physically settled foreign exchange forward contracts to transactions exclusively between 'institutions' (credit institutions and investment firms) or equivalent third-country entities. This means variation margins would not be required for physically settled FX forward contracts where one counterparty is not an 'institution' as defined in Regulation (EU) No 575/2013. The ESAs advise competent authorities to apply the existing EU framework for institution-to-non-institution transactions in a risk-based and proportionate manner until these amended Regulatory Technical Standards enter into force, which is anticipated after 3 January 2018.
