CONCERNING
MUTUAL FUND REPORTING AND ACCOUNTING GUIDELINES BY THE GRACE OF GOD ALMIGHTY THE COMMISSIONERS OF THE FINANCIAL SERVICES AUTHORITY, Considering:
a. that with the transfer of functions, duties, and authority for the regulation and supervision of financial business activities in the capital market sector, including regulations regarding mutual fund reports, from the Capital Market Supervisory Agency and Financial Institutions to the Financial Services Authority; b. that to provide clarity and certainty regarding mutual fund reporting and accounting guidelines, existing legislation in the capital market sector regarding mutual fund reporting and accounting guidelines issued prior to the establishment of the Financial Services Authority needs to be changed into a Financial Services Authority Regulation;
c. that based on the considerations referred to in letters a and b, it is necessary to establish a Financial Services Authority Regulation concerning Mutual Fund Reporting and Accounting Guidelines;
Considering:
DECIDES:
Establish: FINANCIAL SERVICES AUTHORITY REGULATION CONCERNING MUTUAL FUND REPORTING AND ACCOUNTING GUIDELINES.
CHAPTER I
GENERAL PROVISIONS
Article 1
In this Financial Services Authority Regulation, the following terms are defined as:
CHAPTER II
MUTUAL FUND REPORTING
Article 2
Custodian Banks in Open-End Mutual Funds are required to submit reports showing the financial position of each Mutual Fund to the Financial Services Authority in the form of:
a. Mutual Fund Asset and Liability Report using the format contained in Appendix I, which is an integral part of this Financial Services Authority Regulation; b. Mutual Fund Operation Report using the format contained in Appendix II, which is an integral part of this Financial Services Authority Regulation;
c. Mutual Fund Net Asset Change Report using the format contained in Appendix III, which is an integral part of this Financial Services Authority Regulation;
d. Mutual Fund Portfolio Report using the format contained in Appendix IV, which is an integral part of this Financial Services Authority Regulation; e. Mutual Fund Operation Information and Ratios Report using the format contained in Appendix V, which is an integral part of this Financial Services Authority Regulation; and f. Mutual Fund Commitments and Contingencies Report using the format contained in Appendix VI, which is an integral part of this Financial Services Authority Regulation.
Article 3
The submission of reports as referred to in Article 2 must meet the following requirements:
a. reports as referred to in Article 2 letters a, b, c, and d must be submitted every day no later than 10:00 Western Indonesia Time on the next working day; b. reports as referred to in Article 2 letters e and f must be submitted at the end of each month no later than the 5th (fifth) working day of the following month; and
c. reports must be submitted electronically using a system established by the Financial Services Authority.
Article 4
Custodian Banks and Investment Managers are required to ensure the completeness of report data available in the Appendices as referred to in Article 2 and the accuracy of the calculation of Mutual Fund reports submitted.
Article 5
In the case of Closed-End Mutual Funds, reports as referred to in Article 2 must be submitted to the Financial Services Authority by:
a. Investment Manager; b. Appointed Custodian Bank that performs net asset value calculations for Mutual Funds according to the contract; or
c. Board of Directors of Mutual Funds in the form of a Company.
Article 6
(1) Custodian Banks in Open-End Mutual Funds are required to submit financial information to the Investment Manager at the beginning of every working day showing fund positions at the end of the previous working day's activities. (2) The financial information as referred to in paragraph (1) must be submitted using the formats contained in Appendix I and Appendix IV, which are integral parts of this Financial Services Authority Regulation, based on daily data.
Article 7
When repurchasing shares or Units of Participation, Custodian Banks in Open-End Mutual Funds are required to provide confirmation to shareholders or Unit holders with the following information:
a. repurchase date; b. net asset value of the Mutual Fund used to calculate the number of shares or Units of Participation repurchased;
c. number of shares or Units of Participation owned before repurchase;
d. number of shares or Units of Participation repurchased; e. number of shares or Units of Participation owned after repurchase; f. details of gross proceeds from repurchase, consisting of:

Custodian Banks in Open-End Mutual Funds are required to send reports to each shareholder or Unit holder with the following requirements:
a. no later than the 12th (twelfth) day of the following month if in the previous month there was a mutation in the number of shares or Units of Participation owned by the shareholder or Unit holder; b. no later than the 12th (twelfth) day of January representing account positions on December 31; and
c. reports must contain at least the following information:

MUTUAL FUND ACCOUNTING GUIDELINES
First Section
Securities Portfolio Accounting
Article 9
Securities transactions must be recorded on the date of the transaction, with the following requirements:
a. Securities purchased:
d. investments in money market instruments including debt-type Securities with a maturity of less than 1 (one) year are recorded on line number 1 contained in Appendix I with detailed portfolios according to the format contained in Appendix IV, which is an integral part of this Financial Services Authority Regulation; e. investments in other debt instruments including debt-type Securities with a maturity of one year or more, including bonds and convertible debt, are recorded on line number 2 contained in Appendix I with detailed portfolios according to the format contained in Appendix IV, which is an integral part of this Financial Services Authority Regulation; f. investments in shares are recorded in line number 3 contained in Appendix I with detailed portfolios according to the format contained in Appendix IV, which is an integral part of this Financial Services Authority Regulation; g. investments in warrants and rights include warrants and rights that have not yet matured and other Securities, recorded in line number 4 contained in Appendix I with detailed portfolios according to the format contained in Appendix IV, which is an integral part of this Financial Services Authority Regulation; h. undistributed periodic net profit and loss are recorded in accumulated profit and loss up to the previous year and recorded on line number 18 contained in Appendix I, which is an integral part of this Financial Services Authority Regulation; and
i. if Mutual Funds purchase shares in a Public Offering, transaction booking before the allocation date is debited to Other Assets - Advance Payment for Securities and recorded on line number 10 contained in Appendix I, which is an integral part of this Financial Services Authority Regulation, and credited to cash.
Second Section
Profit and Loss Accounting
Article 10
The Investment Accounts of Mutual Funds must be adjusted to fair market value every working day, based on the evaluation of each Security's value as determined in the Financial Services Authority Regulation regarding Fair Market Value of Securities in Mutual Fund Portfolios, with the following requirements:
a. daily adjustments to the value of investment accounts are debited or credited to each investment account and to the account reported on line number 20 contained in Appendix I, which is an integral part of this Financial Services Authority Regulation, as unrealized net profit and loss; and b. subsidiary books are created for each Security showing the purchase price after adding transaction costs.
Article 11
(1) Interest income from debt-type Securities must be recognized daily and debited to interest receivables and credited to unrealized net profit and loss, with the following requirements:
a. if the collectibility of interest receivables is doubtful and/or default occurs, a provision is made for doubtful interest receivables; b. the purchase discount from the principal value of debt-type Securities without coupon interest is recognized daily as interest income;
c. the difference between the purchase price and selling price of debt-type Securities obtained through a repurchase agreement that cannot be canceled is treated as interest income and recognized daily;
d. interest on bonds traded with a price excluding interest that is still receivable is recorded as follows:

(1) Dividend income must:

Realized net profit and loss from the sale of Securities must be determined based on the average cost method, which includes:
a. costs, commissions, and transaction costs; and b. the difference between the average cost of Securities sold and the net selling price is booked in a special profit and loss account for realized profits and losses and reported on line number 21 contained in Appendix I, which is an integral part of this Financial Services Authority Regulation, and on line number 11 of Appendix II, which is an integral part of this Financial Services Authority Regulation.
Article 14
Every realized and unrealized investment income reported on line numbers 20, 21, and 22 contained in Appendix I, which is an integral part of this Financial Services Authority Regulation, must include detailed sub-accounts recording the amount of realized or unrealized investment income that is the right of each shareholder or Unit holder of the Mutual Fund.
Article 15
Management fees, Custodian fees, and other costs related to Open-End Mutual Funds must be charged daily.
Third Section
Open-End Mutual Fund Shares or Units of Participation Accounts
Article 16
Individual share or Unit of Participation accounts issued must be created for each investor in Open-End Mutual Funds, with the following requirements:
a. in the event of issuing shares or Units of Participation, the net sales price of shares or Units of Participation is credited to each investor's account in the Issued Shares or Units of Participation account and reported on line number 16 contained in Appendix I and on line number 7 contained in Appendix III, which are integral parts of this Financial Services Authority Regulation; b. in the event of repurchasing shares or Units of Participation, the amount to be debited to each investor's account in the Issued Shares or Units of Participation account is the same as the previous account balance multiplied by the repurchase ratio;
c. the total value of shares or Units of Participation sold back by shareholders or Unit holders is reported on line number 8 contained in Appendix III, which is an integral part of this Financial Services Authority Regulation; and
d. the difference between the total value of shares or Units of Participation sold back and the value debited to the issued shares or Units of Participation account is debited using the same ratio as referred to in letter b to each investor's realized and unrealized income accounts.
Article 17
(1) Cash distributions to shareholders or Unit holders must:

As determined in the collective investment contract or the articles of association of Open-End Mutual Funds, the net asset value per share or Unit of Participation may be increased or decreased by proportionally modifying the number of shares or Units of Participation owned by each shareholder or Unit holder.
Article 19
The number of shares or Units of Participation owned by each investor in Open-End Mutual Funds must be recorded with at least 3 (three) decimal places.
Article 20
Regarding cash distributions as referred to in Article 17, the custodian is required to provide confirmation to investors regarding the same details of gross proceeds as referred to in Article 7 letters f and g.
CHAPTER IV
ADMINISTRATIVE SANCTIONS
Article 21
(1) Every party that violates the provisions as referred to in Article 2, Article 3, Article 4, Article 5, Article 6, Article 7, Article 8, Article 9, Article 10, Article 11, Article 12, Article 13, Article 14, Article 15, Article 16, Article 17 paragraph (1), Article 19, and Article 20 is subject to administrative sanctions. (2) Sanctions as referred to in paragraph (1) are also imposed on parties causing the violations as referred to in paragraph (1). (3) Sanctions as referred to in paragraph (1) and paragraph (2) are imposed by the Financial Services Authority. (4) Administrative sanctions as referred to in paragraph (1) consist of:
a. written warning; b. fine, namely the obligation to pay a certain amount of money;
c. restriction of business activities;
d. suspension of business activities; e. revocation of business license; f. cancellation of approval; and/or g. cancellation of registration. (5) Administrative sanctions as referred to in paragraph (4) letters b, c, d, e, f, or g may be imposed with or without prior imposition of administrative sanctions in the form of a written warning as referred to in paragraph (4) letter a. (6) Administrative sanctions in the form of fines as referred to in paragraph (4) letter b may be imposed separately or together with the imposition of administrative sanctions as referred to in paragraph (4) letters c, d, e, f, or g. (7) The procedure for imposing sanctions as referred to in paragraph (3) is carried out in accordance with existing legislation.
Article 22
In addition to administrative sanctions as referred to in Article 21 paragraph (4), the Financial Services Authority may take certain actions against any party violating the provisions of this Financial Services Authority Regulation.
Article 23
The Financial Services Authority may announce the imposition of administrative sanctions as referred to in Article 21 paragraph (4) and specific actions as referred to in Article 22 to the public.
CHAPTER V
CLOSING PROVISIONS
Article 24
Upon the enactment of this Financial Services Authority Regulation:
a. Decision of the Chairman of the Capital Market Supervisory Agency Number Kep-06/PM/2004 concerning Mutual Fund Reports, along with Regulation Number X.D.1 which is its appendix; and b. Decision of the Chairman of the Capital Market Supervisory Agency Number Kep-21/PM/2004 concerning Mutual Fund Accounting Guidelines, along with Regulation Number VIII.G.8 which is its appendix, are repealed and declared invalid.
Article 25
This Financial Services Authority Regulation takes effect upon enactment.

CONCERNING
MUTUAL FUND REPORTING AND ACCOUNTING GUIDELINES
I. GENERAL
That since December 31, 2012, the functions, duties, and authority for the regulation and supervision of financial business activities in the capital market, insurance, pension funds, financing institutions, and other financial service institutions have transferred from the Minister of Finance and the Capital Market Supervisory Agency and Financial Institutions to the Financial Services Authority. In light of the above, it is necessary to reorganize the structure of existing regulations, particularly those related to the capital market sector, by converting Capital Market Supervisory Agency and Financial Institutions Regulations related to the capital market sector into Financial Services Authority Regulations. This reorganization is conducted so that Financial Services Authority Regulations related to the capital market sector are consistent with Financial Services Authority Regulations in other sectors. Based on the background and aspects mentioned, it is necessary to replace legislation in the capital market sector regulating Mutual Fund reports, Mutual Fund accounting guidelines, and information in the short financial summary of Mutual Funds, namely:
a. Decision of the Chairman of the Capital Market Supervisory Agency Number Kep-06/PM/2004 concerning Mutual Fund Reports, along with Regulation Number X.D.1 which is its appendix; and
b. The Decree of the Head of the Capital Market Supervisory Agency Number Kep21/PM/2004 concerning Mutual Fund Accounting Guidelines, along with Regulation Number VIII.G.8 which is its appendix, becomes the Otoritas Jasa Keuangan Regulation concerning Mutual Fund Reporting and Accounting Guidelines.
