FSCA COMMUNICATION 10 OF 2026 (FM)
The purpose of this Communication is to inform stakeholders that the Financial Sector Conduct Authority (FSCA) is extending the date for public consultation on the Draft Conduct Standard [-] of 2026 – Requirements relating to the reporting and disclosure of short sales from 15 May 2026 to 3 June 2026.
2.1 On 30 March 2026, the FSCA published FSCA Communication 7 of 2026 (FM), the purpose of which was to inform stakeholders that the FSCA published the following documents for public consultation:
(a) Draft Conduct Standard [-] of 2026 – Requirements relating to the reporting and disclosure of short sales (draft Conduct Standard);
(b) Statement of Need and Impact of the draft Conduct Standard; and
(c) Comments template.
2.2 In terms of the Notice contained on the first page of the draft Conduct Standard, submissions on the draft Conduct Standard must be submitted to the FSCA on or before 15 May 2026.
2.3 However, following inquiries from interested stakeholders, it transpired that the Statement of Need and Impact that was published alongside the draft Conduct Standard was an outdated version. The correct version has now been uploaded to the FSCA website.
2.4 Since the Statement of Need contains important contextual information, including the FSCA responses to comments submitted by commentators on the previous version of the draft Conduct Standard that was published for public consultation in 2025, the FSCA has decided to extend the period to submit comments on the draft Conduct Standard.
2.5 Accordingly, interested parties are requested to submit comments on the draft Conduct Standard in writing, using the submission template available on the FSCA’s website, on or before 3 June 2026 to the FSCA at FSCA.RFDStandards@fsca.co.za.
2.6 The folder containing the draft Conduct Standard, Statement of Need and submission template can be allocated on the FSCA’s website under the following path: Supervisory Information > Documents for Consultation > Capital Markets > 2026 > Draft Conduct Standard for Short Sales
For more information regarding the draft Conduct Standard and/or this Communication, please contact the Regulatory Frameworks Department of the FSCA by emailing tshifhiwa.mavhuthugu@fsca.co.za.
