FSCA Equivalence Framework for Financial Markets: Consultation Report

The report summarises public consultation on the draft Equivalence Framework for financial markets and the draft Determination of licensing requirements for external central counterparties and trade repositories. Over 30 comments from four respondents were received; changes made were not material. The framework operationalises section 27(1) of the CRSA and supplements section 18 endorsement requirements, allowing foreign credit rating agencies, over-the-counter derivative providers, trade repositories and central counterparties to seek equivalence recognition. All equivalence recognitions require concurrence of the Prudential Authority and the South African Reserve Bank. The Joint Standard on exemptions and the Equivalence Framework are expected to take effect in close proximity.
