Guidelines on Significant Risk Transfer for Securitisation

Originator institutions subject to Articles 243 and 244 of Regulation (EU) No 575/2013 must ensure securitisation documentation reflects economic substance, places exposures beyond the originator’s reach, and obtains qualified legal counsel opinions. They must exclude clauses improving positions or increasing yields due to credit deterioration, ensure clean-up call options are exercisable only when 10% or less of original exposure value remains unamortised, and apply sound credit-granting criteria. Institutions must notify competent authorities of new SRT transactions, maintain governance processes, and conduct quarterly monitoring. Competent authorities must assess transactions claiming SRT under Articles 243(2), 244(2), 243(4), or 244(4) of the CRR, including trading book portfolios, using provided reporting templates.
