Kansas Financial Institutions Information Security Act

The Kansas Financial Institutions Information Security Act establishes information security standards for covered entities, including credit services organizations, mortgage companies, supervised lenders, money transmitters, trust companies, technology-enabled fiduciary financial institutions, and earned wage access service registrants. Covered entities must develop, implement, and maintain reasonable safeguards to protect customer information consistent with 16 C.F.R. § 314 as of July 1, 2023, and organize their information security programs into accessible parts. The state bank commissioner is authorized to conduct routine examinations and investigations, with enforcement powers including issuing fines or civil penalties not exceeding $5,000 per violation, censuring entities, revoking licenses, and issuing emergency orders to prevent consumer harm.
