CHAPTER ONE: GENERAL
PROVISIONS

Article One: Purpose
This Regulation aims at preventing issues relating to issuance of bouncing cheques and provide for penalties applicable to cheque defaulters.

Le présent règlement a pour objet de prévenir les problèmes issus de l’ émission des chèques sans provisions et détermine les peines applicables aux émetteurs de chèques sans provision. Article 2: Scope
This Regulation shall apply to bouncing cheques, the paying bank, the presenting bank, and the cheque defaulter.

Iyo sheki igomba kwishyurwa nyir‟ubwite cyangwa umuntu wateganyijwe cyangwa uyitwaje. Icyo gihe ihererekanya ry‟ishusho-koranabuhanga ya sheki risimbura ihererekanya rya sheki mu ntoki; 4° Sheki itazigamiwe: sheki y’umwimerere cyangwa shekikoranabuhanga itishyuwe bitewe no kuba, mu gihe cyose iyo sheki igifite agaciro kayo, nta mafaranga ari kuri konti y‟umukiriya wayitanze cyangwa ayo yabikijweho adahagije; 1° Cheque: an unconditional order in writing that is addressed by its signatory to one bank or one financial institution and requires to pay on demand a sum certain in money to the drawer or to a specified person or to the bearer. The name of the bank or financial institution on which the check is drawn shall be clearly indicated; 2° Physical cheque: paper based document filled from the cheque book; 3° Truncated cheque: cheque truncated during the course of a clearing cycle, either by the clearing house or by the bank whether paying or receiving payment, immediately on generation of an electronic image for transmission, substituting the further physical movement of the cheque in writing; 4° Bouncing cheque: physical or truncated cheque that is not paid due to lack of funds or sufficient funds on the drawer‟s account within the validity period; 1° Chèque: un effet qui fait foi, émis par son signataire à une banque ou une institution financière et ordonnant paiement d’ une somme mentionnée sur cet effet au tireur lui-même ou à une personne désignée ou au porteur. Le nom de la banque ou de l’institution financière à laquelle est donné l’ordre de payer doit être clairement indiqué sur le chèque ; 2° Chèque physique: effet rempli tiré du carnet de chèque ; 3° Chèque dématérialisé: chèque dématérialisé au cours d'un cycle de compensation, soit par la chambre de compensation ou par la banque tirée ou bénéficiaire, immédiatement par la création d'une image électronique générée pour transmission, substituant le mouvement physique du chèque manuellement écrit ; 4° Chèque sans provisions: chèque physique ou dématérialisé qui n’est pas payé pour manque de provisions ou de provisions suffisantes sur le compte du tireur durant la période de validité du chèque ; Official Gazette no.Special of 16/01/2019 47

5° Ikosa rya mbere : itangwa ku nshuro ya mbere rya sheki imwe cyangwa nyinshi zitazigamiwe rikozwe n’uyitanze akayiha cyangwa akaziha banki imwe cyangwa nyinshi ku munsi umwe hatitawe ku gihe izi sheki zitazigamiwe zagerejwe kuri banki kugira ngo zishyurwe ; 6° Ikosa risubiwemo : irindi tangwa iryo ari ryo ryose rya sheki itazigamiwe kugira ngo yishyurwe, rikaba rikozwe n‟uwayitanze nyuma y‟ikosa rya mbere yakoze; 7° Banki yishyura : ni banki cyangwa ikigo cy‟imari iciriritse byohererejwe sheki kugira ngo biyishyure ; 8° Banki yishyuza : banki cyangwa ikigo cy‟imari iciriritse byakira shekikoranabuhanga biyihawe n‟umukiriya cyangwa se n‟uwatumwe kugira ngo yishyurwe; 9° Uwatanze sheki itazigamiwe : ni umuntu watanze sheki ntiyishyurwe kuko kuri konti ye nta mafaranga ariho cyangwa hariho amafaranga atageze ku mubare uri kuri sheki. 5° First incident: first presentation of a bouncing cheque or several bouncing cheques issued by a drawer to a bank or several banks at a same date, irrespective of the time when these bouncing cheques were presented for payment; 6° Subsequent incident: any presentation for payment of a bouncing cheque issued by a drawer after the first incident; 7° Paying Bank: a bank or a Micro finance institution at or through which a cheque is payable and to which the cheque is sent for payment; 8° Presenting Bank: bank or a Micro finance institution that receives the cheque from the customer, either directly or via a third party, or presents the cheque to the clearing house for clearing and settlement; 9° Cheque defaulter: a drawer whose cheque has bounced. 5° Premier incident : première présentation d'un ou plusieurs chèques sans provisions émis à une ou plusieurs banques par le tireur à une même date, quel que soit le moment où ces chèques sans provisions ont été présentés pour paiement ; 6° Incident ultérieur : toute présentation pour paiement d'un chèque sans provision émis par le tireur après le premier incident ; 7° Banque tirée : une banque ou une institution de micro finance sur ou par l’intermédiaire de laquelle un chèque est tiré et à laquelle le chèque est envoyé pour paiement ; 8° Banque remettante : banque ou une institution de micro finance recevant le chèque du client, que ce soit directement ou par l'intermédiaire d'un tiers, ou présente le chèque à la chambre de compensation pour paiement et règlement ; 9° Tireur de chèque sans provision: un émetteur de chèque dont le compte courant est sans provisions. CHAPTER 2: OBLIGATIONS OF THE

1° Kumenyesha umukiriya mu buryo bwanditse kandi busobanutse imikoreshereze ya sheki mbere yo kumuha udutabo twa sheki; 2° Kumenyesha umukiriya mu buryo bwanditse ingaruka zo gutanga sheki zitazigamiwe n‟ibihano bijyanye n‟itangwa ryazo; 3° Kumenyesha umukiriya ko sheki yatanze itishyuwe kubera ko itazigamiwe no kumuha amakuru yose kuri iyo sheki hakoreshejwe inyandiko yabugenewe iriku mugereka w‟aya mabwiriza kandi bikamenyeshwa Banki Nkuru y’u Rwanda; 4° Kumenyesha Banki Nkuru y’u Rwanda n‟Ikigo cy‟Ihererekanyamakuru ku Myenda sheki iyo ari yo yose itazigamiwe bigakorwa hakurikijwe ibisabwa mu imenyekanisha. Article 4: Obligations of the paying bank
The paying bank has the following obligations:
1° Formally and clearly inform the customer on the use of the cheque before providing cheque books; 2° Formally inform the customer of the consequences of issuing bouncing cheques including related sanctions; 3° Formally notify the drawer on its bouncing cheque with detailed information in accordance with standard letter attached in appendix with copy to the National Bank of Rwanda for information; 4° Report all bouncing cheques to the National Bank of Rwanda and Credit Reference Bureau, in accordance with reporting requirements. For reporting purpose, the amount on bouncing cheque(s) denominated in foreign currency shall be converted in Rwandan francs using the exchange rate applicable on the presentation date;

1° Informer officiellement et clairement le client de l'utilisation d’un chèque avant la délivrance des chéquiers. 2° Informer officiellement le client des conséquences de l’émission des chèques sans provisions, y compris des sanctions y relatives ; 3° Fournir officiellement au tireur des informations détaillées sur son chèque sans provisions conformément à la lettre-type présentée en annexe, avec copie pour information à la Banque Nationale du Rwanda ; 4° Soumettre le rapport de tous les cheques sans provision à la Banque Nationale du Rwanda et au Bureau de Crédit, conformément aux exigences de déclaration. A des fins de rapport, le montant du chèque ou des chèques émis en monnaies étrangères est converti en francs rwandais à un taux de change en vigueur à la date de présentation ; Official Gazette no.Special of 16/01/2019 49

Article 5: Obligations of the drawer
The drawer has the following obligations:
1° Hold sufficient funds on the account on the due date until the expiration of validity of the issued cheque; and 2° Officially inform the paying bank of the incident of loss or theft of the cheque or cheque book.

1° Détenir des fonds suffisants sur son compte à la date de paiement jusqu'à l'expiration de la validité du chèque émis; et 2° Informer officiellement la banque tirée de l'incident de perte ou de vol de chèque ou de chéquier. CHAPTER 4: SANCTIONS AND
REMOVAL OF SANCTIONS
CHAPITRE 4: SANCTIONS ET LEVEE DES SANCTIONS Ingingo ya 7: Ibihano bihabwa uwatanze sheki itazigamiwe Hatirengagijwe ibiteganywa n’amategeko ahana icyaha cyo gutanga sheki itazigamiwe, uwatanze bene iyo sheki ntiyemerewe:
1° Guhabwa inguzanyo muri banki, mu bigo by‟imari iciriritse cyangwa mu kigo icyo ari cyo cyose gitanga inguzanyo; 2° Guhabwa agatabo gashya ka sheki na banki iyo ari yo yose cyangwa ikigo cy‟imari iciriritse icyo ari cyo cyose; 3° Gufunguza konti nshya muri banki iyo ari yo yose cyangwa ikigo cy‟imari iciriritseicyo ari cyo cyose.
Article 7: Sanctions applicable to a cheque
defaulter
Without prejudice to the criminal provisions applicable to the offence of issuing bouncing cheque, a cheque defaulter shall not be allowed to:
1° Access any credit facility in banks, microfinance institution or in any lending institution; 2° Be provided a new cheque book by any bank or micro finance institution; 3° Open a new account in a bank or in a microfinance institution.

de chèque sans provision Sans préjudice aux dispositions pénales applicables à l’émission de chèque sans provision, le tireur de chèque sans provision n’est pas autorisé à:
1° Bénéficier de toute facilité de crédit dans les banques, les institutions de micro finance ou tout établissement de crédit; 2° Recevoir de n’importe quelle banque ou institution de micro finance un nouveau carnet de chèques; 3° Ouvrir un nouveau compte auprès d’une banque ou une institution de micro finance. Ibihano bivugwa mu gika cya mbere cy’iyi ngingo bitangwa ku ikosa rya mbere bikamara amezi atandatu (6) naho ku ikosa risubiwemo ibyo bihano bimara umwaka umwe. In addition to sanctions stipulated in paragraph one of this article, a cheque defaulter shall return back all cheque books given to him by his banks or micro finance institutions. Sanctions stipulated in paragraph one of this
article shall apply for a period of six (6) months
for the first incident and one year for subsequent incidents. En plus des sanctions prévues à l'alinéa premier du présent article, le tireur de chèque sans provision doit retourner tous les carnets de chèques reçus de ses banques ou institutions de micro finance. Les sanctions prévues à l'alinéa premier du présent article sont applicables pour une période de six (6) mois pour le premier incident et un an pour les incidents ultérieurs. Article 8: Conditions for removal of
sanctions
The sanctions stipulated in Article 7 of this Regulation shall be removed subject to the following:
1° Proof of payment of all bouncing cheques drawn by the cheque defaulter and certified by the paying bank. This proof should indicate the date of settlement ofthe cheque; 2° Clearance letter from the National Public Prosecution Authority; 3° Payment of pecuniary sanction equivalent to 20% of the amount mentioned on each bouncing cheque, and

Les sanctions prévues à l'article 7 du présent règlement doivent être levés sous réserve de ce qui suit:
1° La preuve du paiement de tous les chèques sans provisions émis par le tireur de chèque sans provision et certifiée par la banque tirée. Cette preuve doit indiquer la date de paiement du chèque ; 2° La lettre de non poursuite délivrée par l’Organe Nationale de Poursuite Judiciaire ; 3° Le paiement d’une sanction pécuniaire de 20% du montant mentionné sur chaque chèque sans provision, et Official Gazette no.Special of 16/01/2019 52

4° Kurangiza igihe ibihano bimara nk‟uko biteganywa mu ngingo ya 7 y‟aya mabwiriza. Mu izina ry’uwatanze sheki itazigamiwe, Ubuyobozi bwa banki yishyura bwandikira Banki Nkuru y‟u Rwanda busaba ko ibihano bivanwaho. Idosiye isaba igomba kuba igaragaramo inyandiko zemeza ku buryo budashidikanywaho ko ibisabwa bivugwa mu gika cya mbere cy’iyi ngingo byubahirijwe. Uwatanze sheki itazigamiye yishyura amafaranga y‟igihano avugwa mu gika cya mbere cy‟iyi ngingo akagabanywa ku buryo bungana hagati ya banki yishyura na Banki Nkuru y‟u Rwanda. Banki yishyura yoherereza Banki Nkuru y’u Rwanda uruhare rwayo hanyuma inyandiko ibyemeza igashyirwa muri dosiye isaba gukurirwaho ibihano. 4° Completion of the sanction period specified in article 7 of this Regulation. The Management of the paying bank shall on behalf of the cheque defaulter, apply to the National Bank of Rwanda for the removal of sanctions. The application file shall contain documents proving beyond any reasonable doubt that the requirements stipulated in paragraph one of this Article have been met. The pecuniary sanction whose amount is specified in the paragraph one of this article shall be paid by the cheque defaulter and shall be equally shared between the paying bank and the National Bank of Rwanda. The paying bank shall transfer the portion of the National Bank of Rwanda and submit the proof together with the application file for removal of sanctions. 4° L'accomplissement de la période des sanctions prévue à l'article 7 du présent règlement. L’Administration de la banque tirée, au nom du tireur de chèque sans provision, écrit à la Banque Nationale du Rwanda pour demander la levée des sanctions. Le dossier de demande doit contenir des documents prouvant, sans le moindre doute, que les exigences prévues à l'alinéa premier du présent article ont été respectées. Le montant de la sanction pécuniaire visé à l’alinéa premier du présent article sera versé par le tireur de chèque sans provision et sera partagé à parts égales entre la banque tirée et la Banque Nationale du Rwanda. La banque tirée doit transférer la part revenant à la Banque Nationale du Rwanda et la preuve doit être transmise avec le dossier de demande de levée des sanctions. Article 9: Reply to the application for
removal of sanctions
Upon reception of a complete file as specified in article 8 of this regulation, the National Bank of Rwanda shall analyze the application and reply by a written letter to the applicant bank with a copy to all banks, other relevant financial institutions and the Credit Reference Bureau within a period of seven (7) working days.

A bank which reports a cheque as bouncing while untrue shall be charged a pecuniary sanction of three hundred thousand Rwandan Francs (FRW 300,000) by the National Bank of Rwanda for each cheque so reported.

Article 11: Repealing provision
The regulation No 006/2015 of 16/09/2015 of the National Bank of Rwanda relating to bouncing cheques and all prior regulatory provisions inconsistent with this Regulation are hereby repealed.

Access any credit facility in banks, microfinance institution or in any lending institution;

The sanctions stipulated here above shall apply for a period of six (6) months for the first incident and one year for subsequent incidents.
