The Guidelines of the European Banking Authority of 4 July 2024 on information requirements for transfers of funds and certain crypto-assets under Regulation (EU) 2023/1113 ('Travel Rule Guidelines') (EBA/GL/2024/11) are applied by the National Bank of Belgium in the exercise of its supervisory mission regarding anti-money laundering and counter-terrorist financing obligations.
Pursuant to Article 16, paragraph 3 of Regulation (EU) No 1093/20103, PSPs and PSCAs shall make every effort to comply with these guidelines which entered into application on 30 December 2024.

By this circular, the National Bank of Belgium (the 'Bank') communicates that it has integrated the Guidelines of the European Banking Authority ('EBA') of 4 July 2024 on information requirements for transfers of funds and certain crypto-assets under Regulation (EU) 2023/1113 ('Travel Rule Guidelines') (EBA/GL/2024/11; the 'Guidelines') into the exercise of its supervisory mission regarding anti-money laundering and counter-terrorist financing obligations referred to in Article 36/2, § 2 of the Law of 22 February 1998 laying down the organic statute of the Bank.
The Guidelines detail the requirements regarding internal control policies, procedures and measures required by Regulation (EU) 2023/1113 and by Article 8, § 1, 2° of the Law of 18 September 2017, in order to ensure that the information required by Regulation (EU) 2023/1113 accompanies transfers of funds and crypto-assets involving the PSPs and PSCAs, whether they act as the originator's PSP or the initiator's PSCA, as the beneficiary's PSP or PSCA, or as an intermediary PSP or PSCA.
The Bank draws attention to the requirements regarding policies and procedures related to cross-border transfers of funds and involving multiple intermediaries, these policies and procedures must describe how the required information is transmitted throughout the transfer chain to the next payment service provider and the next intermediary payment service provider in said chain (section 4.3.2 of the Guidelines).
The Bank also recalls that a fund transfer as defined in Article 3, point 9) of Regulation (EU) 2023/1113 includes in particular a transmission of funds within the meaning of Article 2, 4° of the Law of 11 March 20184.
Pursuant to Article 16, paragraph 3 of Regulation (EU) No 1093/2010, PSPs and PSCAs shall make every effort to comply with these guidelines which entered into application on 30 December 2024, published on the EBA website and annexed to this circular.
