EBA Guidelines on information requirements for fund transfers and certain crypto-assets under Regulation (EU) 2023/1113 ('Travel Rule Guidelines') (EBA/GL/2024/11 of 4 July 2024)

Scope
This circular applies to the regulated entities referred to in:

1. Article 5, § 1, first paragraph, 4°, 6° and 7° of the Law of 18 September 20171 which provide the fund transfer service referred to in Article 3, point 9) of Regulation (EU) 2023/11132 (the 'PSPs');
2. Article 5, § 1, first paragraph, 4°, 6°, 7° and 10° of the Law of 18 September 2017 which provide the crypto-asset transfer service referred to in Article 3, point 10) of Regulation (EU) 2023/1113 (the 'PSCAs');
   hereinafter collectively referred to as the 'PSPs and PSCAs'.

Summary/Objectives
The Guidelines of the European Banking Authority of 4 July 2024 on information requirements for fund transfers and certain crypto-assets under Regulation (EU) 2023/1113 ('Travel Rule Guidelines') (EBA/GL/2024/11) are applied by the National Bank of Belgium in the exercise of its supervisory mission regarding anti-money laundering and counter-terrorist financing obligations.

Pursuant to Article 16, paragraph 3 of Regulation (EU) No 1093/20103, PSPs and PSCAs shall make all efforts to comply with these guidelines which entered into application on 30 December 2024.

By this circular, the National Bank of Belgium (the 'Bank') communicates that it has integrated the Guidelines of the European Banking Authority ('EBA') of 4 July 2024 on information requirements for fund transfers and certain crypto-assets under Regulation (EU) 2023/1113 ('Travel Rule Guidelines') (EBA/GL/2024/11; the 'Guidelines') into the exercise of its supervisory mission regarding anti-money laundering and counter-terrorist financing obligations referred to in Article 36/2, § 2 of the Law of 22 February 1998 laying down the organic statute of the Bank.

The Guidelines detail the requirements relating to the policies, procedures and internal control measures required by Regulation (EU) 2023/1113 and by Article 8, § 1, 2° of the Law of 18 September 2017, in order to ensure that the information required by Regulation (EU) 2023/1113 accompanies fund and crypto-asset transfers involving PSPs and PSCAs, whether they act as the PSP of the orderer or the PSCA of the originator, as the PSP or PSCA of the beneficiary, or as an intermediate PSP or PSCA.

The Bank draws attention to the requirements relating to policies and procedures regarding cross-border fund transfers and those involving multiple intermediaries; these policies and procedures must describe how the required information is transmitted throughout the transfer chain to the payment service provider and the next intermediate payment service provider in said chain (section 4.3.2 of the Guidelines).

The Bank also recalls that a fund transfer as defined in Article 3, point 9) of Regulation (EU) 2023/1113 notably includes a transmission of funds within the meaning of Article 2, 4° of the Law of 11 March 20184.

Pursuant to Article 16, paragraph 3 of Regulation (EU) No 1093/2010, PSPs and PSCAs shall make all efforts to comply with these guidelines which entered into application on 30 December 2024, published on the EBA website and annexed to this circular.

A copy of this circular is sent to the auditor(s) and approved auditor(s) of your establishment.
