Normative Instruction BCB No. 248 — Amends and Consolidates Normative Acts Regarding the Submission of Information on Consortium Operations to the Central Bank of Brazil

NORMATIVE INSTRUCTION BCB NO. 248, OF MARCH 28, 2022

Regulatory document revoked by Normative Instruction BCB No. 525, of 9/19/2024.

Amends and consolidates normative acts regarding the submission of information related to consortium operations to the Central Bank of Brazil.

The Head of the Department of Supervision of Cooperatives and Non-Bank Institutions (Desuc), using the authority conferred by him by art. 23, item I, letter "a", of the Internal Regulations of the Central Bank of Brazil, annexed to Ordinance No. 84,287, of February 27, 2015, based on art. 86, item X, of the aforementioned Regulations,

R E S O L V E :

Art. 1º The submission of information related to consortium operations, as provided for in art. 1º of Circular No. 3,394, of July 9, 2008, must be carried out monthly, until the 30th day of the month following the reference date, through Document 2080 - Position of Shares and Groups of Consortium Operations - Real and Movable Assets.

Art. 2º Document 2080 must be sent to the Central Bank of Brazil in electronic format, through the File Transfer System (STA), in the manner regulated and made available on the Central Bank of Brazil's internet page, at the electronic address https://www.bcb.gov.br/acessoinformacao/sistematransferenciaarquivos.

Art. 3º The layout of Document 2080, composed of sets of consolidated and individualized information that must be inserted with monthly and quarterly periodicity respectively, and the instructions for its completion, in the versions established by Normative Instruction BCB No. 221, of December 27, 2021, are available on the Central Bank of Brazil's internet page, at the electronic address https://www.bcb.gov.br/estabilidadefinanceira/documento2080.

Art. 4º The records of data related to the situation of the administrator must be permanently kept updated in the Information System on Entities of Interest to the Central Bank - Unicad, "Operations" module:

a) independent or;

b) linked to manufacturers of the goods related to segments II, III, IV and V, referred to in art. 2º of Circular No. 3,394, of 2008 and/or;

c) linked to a retail trade company and/or;

d) linked to a financial institution.

Art. 5º Consortium administrators must indicate and register, in the Information System on Entities of Interest to the Central Bank – Unicad, an employee qualified to answer any questions regarding the information provided in accordance with this Normative Instruction.

Art. 6º The following are revoked:

I - Circular Letter No. 3,335, of August 1, 2008;

II - Circular Letter No. 3,348, of October 31, 2008;

III - Circular Letter No. 3,591, of April 1, 2013;

IV - Circular Letter No. 3,679, of November 13, 2014.

Art. 7º This Normative Instruction enters into force on the date of its publication.

NOTE

1. This Normative Instruction aims to amend and consolidate normative acts that establish procedures for the submission of information related to consortium operations, as provided for in Circular No. 3,394, of July 9, 2008, pursuant to the provisions of Decree No. 10,139, of November 28, 2019.

2. Only minor changes were made regarding the provisions of Circular Letters No. 3,335, of August 1, 2008, 3,348, of October 31, 2008, 3,591, of April 1, 2013 and 3,679, of November 13, 2014, now revoked, in order to update the information regarding them, for example, of applications through which information is sent to the Central Bank of Brazil or provisions that referred to past dates.

3. It should be noted that the provisions of the revoked Circular Letters regarding changes to the layout and filling instructions of document 2080 - Position of Shares and Groups of Consortium Operations - Real and Movable Assets remain in force, as they were incorporated into the most recent versions of the layout and filling instructions, as provided for in Normative Instruction BCB No. 221, of December 27, 2021.

4. Provisions regarding the registration of data and information in the Information System on Entities of Interest to the Central Bank – Unicad were also consolidated, previously regulated in Circular Letters No. 3,335, of 2008, and 3,679, of 2014.

5. Given that the provisions of this Normative Instruction are considered of low regulatory impact and aim at the update or revocation of norms considered obsolete, without change of merit, in accordance with items III and IV of art. 4º of Decree No. 10,411, of 2020, there is no need to prepare a regulatory impact analysis as provided for in art. 5º of Law No. 13,874, of September 20, 2019.
