NORMATIVE INSTRUCTION BCB NO. 492, OF JULY 24, 2024

Amends MCR Document 2 - Loss Communication (COP), MCR Document 3 - Loss Verification Report (RCP), and MCR Document 4 - Summary of Judgment and Review of Coverage Request, of the Rural Credit Manual (MCR).

The Head of the Department of Regulation, Supervision and Control of Rural Credit and Proagro Operations (Derop), using the powers conferred upon him by Art. 23, item I, letter “a”, of the Internal Regulations of the Central Bank of Brazil, annexed to Resolution BCB No. 340, of September 21, 2023, and based on the provisions of letter “m” of item 1 of Section 1 of Chapter 12 of the Rural Credit Manual (MCR),

R E S O L V E S:

Art. 1º The MCR Document 2 - Loss Communication (COP), MCR Document 3 - Loss Verification Report (RCP), and MCR Document 4 - Summary of Judgment and Review of Coverage Request of the Rural Credit Manual (MCR) are hereby updated.

Sole Paragraph. The MCR Document 2 - Loss Communication (COP), MCR Document 3 - Loss Verification Report (RCP), and MCR Document 4 - Summary of Judgment and Review of Coverage Request will be made available on the website of the Central Bank of Brazil, on the MCR consultation page, available at the electronic address www3.bcb.gov.br/mcr.

§ 1º The MCR Document 2 - Loss Communication (COP), MCR Document 3 - Loss Verification Report (RCP), and MCR Document 4 - Summary of Judgment and Review of Coverage Request will be made available on the website of the Central Bank of Brazil, on the MCR consultation page, available at the electronic address www3.bcb.gov.br/mcr. § 2º The documents updated by this article apply to operations classified under Proagro from July 1, 2024. (Included by Normative Instruction BCB No. 518, of 3/9/2024.)

Art. 2º This Normative Instruction BCB enters into force on the date of its publication.

NOTE

The changes made in this Normative Instruction aim to update MCR Document 2 - Loss Communication (COP), MCR Document 3 - Loss Verification Report (RCP), and MCR Document 4 - Summary of Judgment and Review of Coverage Request, due to changes in the rules of the Agricultural Activity Guarantee Program (Proagro) promoted by CMN Resolution No. 5.125, of April 8, 2024, which alters rules regarding the process of presenting and analyzing proof of purchase of inputs; by CMN Resolution No. 5.126, of April 8, 2024, which adjusts the limit value for classification of rural credit operations in Proagro; by CMN Resolution No. 5.127, of April 8, 2024, which adjusts the coverage limits applicable to enterprises with a probability of loss of yield due to adverse meteorological events equal to 40% (forty percent) and 30% (thirty percent), according to recommendations of the Climate Risk Agricultural Zoning (Zarc); and by CMN Resolution No. 5.128, of April 8, 2024, which adjusts the calculation method and limits of the Minimum Income Guarantee.

2. It should be noted that, by virtue of Art. 24 of Decree No. 10.411, of June 30, 2020, the issuance of normative acts by bodies and entities of the direct, autarchic, and foundation federal administration, from October 14, 2021, must be preceded by a Regulatory Impact Analysis (RIA). However, in its Article 4º, the aforementioned decree establishes the hypotheses for exemption from carrying out an RIA. This IN BCB falls under the hypothesis provided for in item II of the caput of Art. 4º of Decree No. 10.411, of 2020, as it is a normative act intended to regulate an obligation defined in a hierarchically superior norm that does not allow, technically or legally, different regulatory alternatives. Thus, based on item II of the caput of Art. 4º of Decree No. 10.411, of 2020, it is understood that the issuance of this IN BCB is exempt from carrying out an RIA.
