FINANCIAL SERVICES AUTHORITY REGULATION
REPUBLIC OF INDONESIA
NUMBER 5 OF 2026
ON
THE IMPLEMENTATION OF INVESTMENT MANAGER BUSINESS ACTIVITIES
I. GENERAL
Investment Managers play a strategic role in mobilizing and managing public funds through portfolio management for the benefit of clients individually or collectively, thereby requiring increased professionalism, compliance, governance, risk management, capital adequacy, and consumer protection to realize a regulated, fair, and efficient Capital Market ecosystem.
Along with the development of the investment management industry, it is necessary to refine regulations regarding the implementation of Investment Manager business activities to align with the dynamics of current laws, institutions, and industry practices while providing legal certainty.
Based on Law Number 8 of 1995 regarding Capital Markets as amended by Law Number 4 of 2023 regarding the Development and Strengthening of the Financial Sector, it is regulated that Securities Companies acting as Investment Managers cannot conduct activities as underwriters of securities and commodity brokers, so Investment Managers need to increase their capacity and professionalism. In addition, it is necessary to organize and develop the efficiency and effectiveness of Investment Manager business activities in investment management to strengthen the resilience and competitiveness of Investment Managers in the investment management industry.
That the Decision of the Chairman of the Capital Market Supervisory Board and Financial Institutions Number: KEP-479/BL/2009 dated 31 December 2009 regarding Licensing of Securities Companies Conducting Business Activities as Investment Managers as amended by the Decision of the Chairman of the Capital Market Supervisory Board and Financial Institutions Number: KEP-26/BL/2010 regarding the Change of Decision of the Chairman of the Capital Market Supervisory Board and Financial Institutions Number: KEP479/Bl/2009 regarding Licensing of Securities Companies Conducting Business Activities as Investment Managers along with Regulation Number V.A.3 which is its annex needs to be adjusted to the development of the investment management industry in the Capital Market through the establishment of a Financial Services Authority Regulation regarding the Implementation of Investment Manager Business Activities.
This Financial Services Authority Regulation regulates the grouping of MIKU, consisting of MIKU 1 and MIKU 2. MIKU 1, in carrying out investment management activities, has restrictions on the types of Investment Products that can be managed and adjustments to the implementation of Investment Manager function obligations. For MIKU 2, it can manage all types of Investment Products. The grouping of MIKU is accompanied by the establishment of capital requirements, including paid-up capital, Net Liquid Assets (MKBD), and minimum managed funds. In addition, there is an obligation for MIKU 2 to have independent commissioners and directors who oversee the compliance function.
Based on these considerations, it is necessary to establish regulations regarding the implementation of Investment Manager business activities.
With this Financial Services Authority Regulation, it is expected to increase the capacity and professionalism of Investment Managers and encourage the resilience and efficiency of the investment management industry to support the deepening of the Indonesian Capital Market.
Generally, this Financial Services Authority Regulation contains main materials including the implementation of MIKU activities, Investment Manager criteria, procedures for applying for Investment Manager licensing, changes in Investment Manager business activity grouping, ownership and Control, continuing obligations, supervision, reporting, electronic system for submitting data, information, and/or reports, revocation of business licenses, dissolution of Investment Managers, and human resource quality development.
