Oregon Bulletin 2016-01: Nondiscrimination Related to Transgender Persons in Insurance Transactions

The Oregon Department of Consumer and Business Services issued Bulletin 2016-01 to prohibit discrimination against transgender persons in all lines of insurance following a public comment period. The final bulletin clarifies that unlawful discrimination based on gender identity applies to all insurance types and prohibits insurers from imposing additional requirements or demanding premiums based on perceived gender identity. It further mandates that insurers cover medically necessary gender-affirming treatments and sex-specific services regardless of gender identity while requiring staff training to eliminate discriminatory actions.
