Oregon Division of Financial Regulation Bulletin 2017-1: Contraceptive Extended Dispensing Mandate Administration

The Oregon Division of Financial Regulation issued Bulletin 2017-1 to clarify insurer obligations under ORS 743A.066 regarding the reimbursement for three-month initial and twelve-month subsequent dispensing of prescription contraceptives. The bulletin mandates that insurers remain solely responsible for ensuring third-party administrators and pharmacy benefit managers comply with these extended dispensing requirements without imposing restrictive supply limits or excessive copays. Noncompliant practices such as limiting quantities to one-month supplies or requiring multiple copays for a full year's supply are explicitly prohibited as of March 7, 2017.
