Oregon Division of Financial Regulation Bulletin DFR 2018-02: Implementation of Balance Billing Legislation
The Oregon Division of Financial Regulation issued Bulletin DFR 2018-02 to clarify supervisory expectations regarding the implementation of balance billing bans under 2017 HB 2339 and 2018 SB 1549. The bulletin mandates that providers cannot balance bill consumers for out-of-network services rendered in in-network facilities for interactions occurring on or after March 1, 2018, unless specific informed consent and documentation criteria are met. Additionally, it directs that all requests for All-Payer, All-Claims Database data must flow through the advisory committee process and requires insurers and providers to negotiate reimbursement rates consistent with statutory provisions until formal rules are adopted.
