PS26/5: Changes to the UK Short Selling Regime

The Financial Conduct Authority implements new short selling rules and a Statement of Policy that replace assimilated EU regulation, establishing a new Sourcebook within the FCA Handbook. The rules modify the market maker exemption by replacing instrument-specific notifications with a single activity-based notification and requiring an annual attestation, while extending the position reporting deadline to 23:59 on the working day following the trigger. The new regime comes into force in two phases, with Phase 1 starting on 13 July 2026 and Phase 2 introducing bulk submission capabilities on 30 November 2026.
