Directive
Whereas, the Bangladesh Securities and Exchange Commission has decided that, for the development of the capital market and in the interest of investors, it is necessary to clarify certain matters regarding the application of Rule 80(3) of the Bangladesh Securities and Exchange Commission (Mutual Fund) Rules, 2001;
Therefore, in exercise of the powers conferred under Section 20A of the Securities and Exchange Ordinance, 1969, the Commission hereby issues the following directive:
"For the purpose of Rule 80(3) of the Bangladesh Securities and Exchange Commission (Mutual Fund) Rules, 2001, in any case where a bank, having registered with the Commission as a Custodian, operates as the Custodian of securities and other assets of a mutual fund scheme, the condition for the relevant mutual fund's financial statements prepared by the asset manager to be signed by said bank shall be relaxed:
Provided that, an employee nominated by the Board of Directors of said bank shall provide certification regarding the accuracy of the details of the custodied assets included in the relevant financial statements and the information regarding custody."
This directive shall take effect immediately.
