RESOLUTION
ON THE APPROVAL OF THE GUIDELINES FOR THE PROVISION OF INFORMATION BY CENTRAL SECURITIES DEPOSITORIES AND OPERATORS OF SECURITIES SETTLEMENT SYSTEMS TO THE BANK OF LITHUANIA 16 January 2018 No 03-4 Vilnius Acting in accordance with Article 42(3)(1) of the Republic of Lithuania Law on the Bank of Lithuania, Article 91(6) of the Republic of Lithuania Law on Markets in Financial Instruments and Article 6(4) of the Republic of Lithuania Law on Settlement Finality in Payment and Securities Settlement Systems, the Board of the Bank of Lithuania has r e s o l v e d:
1. To approve the Guidelines for the Provision of Information by Central Securities Depositories and Operators of Securities Settlement Systems to the Bank of Lithuania (attached).
2. To authorise the Economics and Financial Stability Service of the Bank of Lithuania to draw up by 31 March 2018 instructions for completing the report form provided in Annex 1 to the Guidelines for the Provision of Information by Central Securities Depositories and Operators of Securities Settlement Systems to the Bank of Lithuania and to amend them if necessary.
3. To repeal Resolution No 03-71 of the Board of the Bank of Lithuania of 8 May 2014 on the approval of the guidelines for the provision of information by the Central Securities Depository of Lithuania to the Bank of Lithuania.

CHAPTER I
GENERAL PROVISIONS
1. The Guidelines for the Provision of Information by Central Securities Depositories and Operators of Securities Settlement Systems to the Bank of Lithuania (hereinafter – the Guidelines) specify the contents, periodicity and provision of information to be submitted to the Bank of Lithuania by central securities depositories, branches of foreign central securities depositories established in the Republic of Lithuania (hereinafter – Central Depository) and operators of securities settlement systems whose participants have chosen to set out their rights and obligations arising from their participation in the system in line with the laws of the Republic of Lithuania (hereinafter – System Operator).
2. Information indicated in the Guidelines shall be submitted to the Bank of Lithuania by electronic means (system for submitting unstructured and partially structured documents to the Bank of Lithuania (AFS)), with the exception of cases when the Bank of Lithuania agrees with the Central Depository or System Operator on other ways to provide information.
3. Terms used in the Guidelines shall be understood as they are defined in the Republic of Lithuania Law on Markets in Financial Instruments and the Republic of Lithuania Law on Settlement Finality in Payment and Securities Settlement Systems.
CHAPTER II
INFORMATION PROVISION
4. The System Operator must provide information on the operation of the securities settlement system within 10 business days after the end of each quarter. Data and information shall be provided in the Report on the Securities Settlement System (Annex 1 to the Guidelines).
5. The Central Depository must provide monthly information on ISIN codes assigned to securities issued by companies established in the Republic of Lithuania and registered in the Central Depository, as well as issue, assimilation and closing of securities within 10 business days after the end of each month. The Report shall indicate the changes in the issues of companies’ securities (of each company separately) over the reporting month (according to the list provided in Annex 2 to the Guidelines).
6. If the System Operator manages several securities settlement systems, information on each securities settlement system whose participants have chosen to set out their rights and obligations arising from their participation in the system in line with the laws of the Republic of Lithuania shall be provided.
CHAPTER ΙΙΙ
FINAL PROVISIONS
7. At the request of the Bank of Lithuania, the Central Depository and/or System Operator must also provide other information related to the activities of the Central Depository or account managers which is relevant to implementation of the functions of the Bank of Lithuania.
8. Having examined the information provided by the Central Depository and/or System Operator, the Bank of Lithuania may request additional information and explanations in order to eliminate any deficiencies in the information provided.
