Rule · BCB · 19 Dec 2002 · Resolução CMN 3054
Authorized clearinghouses and settlement service providers may permit repo transactions where the seller does not own the securities at the time of negotiation, provided they are registered and settled within the same clearinghouse or authorized provider. This permission replaces the ownership requirement in Article 16 of Resolution No. 2,950 of 2002. Participants must not execute unauthorized transactions, manipulate prices, or provide inaccurate information. Non-compliance subjects institutions and administrators to sanctions under existing legislation. This resolution enters into force on the date of its publication.
Dispenses with the requirement for title ownership in repo transactions under the Regulation annexed to Resolution 2,950 of 2002.
The CENTRAL BANK OF BRAZIL, in accordance with Article 9 of Law No. 4,595 of December 31, 1964, makes public that the NATIONAL MONETARY COUNCIL, in a session held on December 19, 2002, based on Article 4, items VI and VIII, of the aforementioned law and on Articles 9, 10, 14, and 29 of Law No. 4,728 of July 14, 1965,
RESOLVES:

Article 2. As a consequence of the provisions of Article 1, Article 16 of the Regulation annexed to Resolution No. 2,950 of 2002 is amended, which shall henceforth read as follows:
"Article 16.
