Rule · BCB · 28 Nov 2005 · Resolução CMN 3331
Financial institutions must verify that municipalities with over 100,000 inhabitants meet Complementary Law 101 limits before contracting credit. They must hire independent auditors for annual compliance reports and submit them to the Ministry of Cities by October 31. Borrowers must include reimbursement clauses in bidding notices for public-private partnership studies. Institutions must cancel Cadip registrations for unapproved proposals and follow joint Ministry of Planning and Finance selection rules. Non-compliance triggers an Agreement for Performance Improvement with the Ministry of Cities, imposing penalties like restricted access to new contracts and accelerated amortization.
