RESOLUTION NO. 4,196, OF MARCH 15, 2013
Provides for transparency measures in the contracting and disclosure of service packages.
The Central Bank of Brazil, in accordance with Art. 9 of Law No. 4,595, of December 31, 1964, makes it public that the National Monetary Council, in an extraordinary session held on March 15, 2013, based on Art. 4, items VIII and IX, of the aforementioned law,
RESOLVES:
Art. 1 Financial institutions must clarify to natural person clients, at the time of contracting services related to their deposit accounts, about the option to choose, without the need for specific adherence or contracting of a service package, the use of services and payment of individualized tariffs, in addition to those free services provided for in current regulations.
Sole Paragraph. The option to use individualized services and tariffs or packages offered by the institution must be prominently stated in the deposit account opening contract.
Art. 2 In addition to the standardized priority service package provided for in current regulations, which encompasses the services of registration, withdrawal, statement, and transfer of funds, financial institutions are also obliged to make available to natural persons the standardized packages contained in the annexed tables to this Resolution.
Art. 3 The service packages referred to in Art. 2 must be disclosed, in a location and format visible to the public, within their premises and on their respective websites on the internet, as well as in the premises of their correspondents in the country.
Art. 4 Financial institutions must make available for consultation, on their respective websites on the internet and in other means used for communication with the client, information about the contracted service package, as well as clarifications about the existence of other packages available for contracting.
Art. 5 This Resolution enters into force on the date of its publication, producing effects from July 1, 2013.
