On Amendments and Additions to Certain Regulatory Legal Acts of the National Bank of the Kyrgyz Republic
In accordance with Articles 20 and 68 of the Law of the Kyrgyz Republic "On the National Bank of the Kyrgyz Republic, Banks and Banking Activity", the Board of the National Bank of the Kyrgyz Republic
RESOLVES:
Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Instruction on Determining Capital Adequacy Standards for Commercial Banks of the Kyrgyz Republic" dated July 21, 2004 No. 18/2;
Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Instruction on Determining Capital Adequacy Standards for Banks Conducting Operations in Accordance with Islamic Principles of Banking and Finance" dated December 28, 2009 No. 51/4;
Resolution of the Board of the National Bank of the Kyrgyz Republic "On Certain Regulatory Legal Acts of the National Bank of the Kyrgyz Republic" dated August 25, 2005 No. 26/5;
Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Regulation 'On Periodic Regulatory Reporting of Banks Conducting Operations in Accordance with Islamic Principles of Banking and Finance'" dated March 30, 2011 No. 20/4.
This Resolution enters into force on May 1, 2019.
Establish the following deadlines for banks conducting operations in accordance with Islamic principles of banking and finance to comply with Category 6 (credit risk degree - 150%) of paragraph 24 of the Instruction on Determining Capital Adequacy Standards for Banks Conducting Operations in Accordance with Islamic Principles of Banking and Finance:
publish this Resolution on the official website of the National Bank of the Kyrgyz Republic;
after official publication, send this Resolution to the Ministry of Justice of the Kyrgyz Republic for inclusion in the State Register of Regulatory Legal Acts of the Kyrgyz Republic.
The Department of Banking Supervision and Licensing Methodology shall bring this Resolution to the attention of commercial banks, the specialized financial-credit organization JSC "Financial Company of Credit Unions", the Non-Profit Partnership "Union of Banks of Kyrgyzstan", the Non-Profit Partnership "Association of Islamic Finance", corresponding structural subdivisions, regional departments, and the representative office of the National Bank of the Kyrgyz Republic in the Batken region.
Control over the implementation of this Resolution is entrusted to the Member of the Board of the National Bank of the Kyrgyz Republic overseeing the Department of Banking Supervision and Licensing Methodology.

"9-1. In order to maintain the financial stability of the bank and the stability of its activities, a requirement is established for supporting the 'additional bank capital reserve' (the 'capital buffer index') for dividend payments. The 'capital buffer index' is determined similarly to the calculation of the total capital adequacy ratio. The value of the 'capital buffer index' for banks is established by the Supervisory Committee of the National Bank.;
"9-2. A bank does not have the right to make a decision on dividend payment if the 'capital buffer index', calculated taking into account the deduction of the amount of dividends planned for payment, will be below the value established by the National Bank.
After the payment of dividends, the 'capital buffer index' must be at a value not lower than that established by the National Bank.
In case of compliance with the value of the 'capital buffer index', calculated taking into account the deduction of the amount of dividends planned for payment, the bank must obtain permission from the National Bank for payment, except in cases where the bank increases its charter capital at the expense of undistributed profit.;
paragraph 9-3 is recognized as having lost force;

In the event of a threat to the stability of the bank, the National Bank may prohibit or impose restrictions on the payment of dividends if:
a) the payment of dividends will lead to a violation of economic standards established by the National Bank;
b) the values of the capital adequacy (sufficiency) ratios of the bank will be below the minimum limits established by the National Bank for this bank;
c) the 'capital buffer index', after the payment of dividends, will be below the minimum values established by the National Bank;
d) reserves for covering potential losses and losses have not been created or are created in an insufficient amount, in accordance with the requirements of the National Bank;
e) the bank has uncovered losses for previous years and/or for the reporting year;
f) this will lead to a deterioration of the financial condition of the bank;
g) in other cases provided for by the laws of the Kyrgyz Republic.
The Bank does not have the right to make a decision on the payment (declaration) of dividends on shares if, at the time of making the decision and payment of dividends, it meets the signs of insolvency in accordance with the legislation of the Kyrgyz Republic or such signs appear in the bank as a result of the payment of dividends.
The Bank does not have the right to make a decision on the payment (declaration) of dividends on ordinary shares if no decision has been made on the payment of dividends on preferred shares.".
