RESOLUTION

of September 9, 2019 No. 2019-P-33/47-4-(NFKU)

On Amendments and Changes to Certain Regulatory Legal Acts of the National Bank of the Kyrgyz Republic

(In the edition of the Resolutions of the Board of the National Bank of the Kyrgyz Republic of September 25, 2019 No. 2019-P-33/49-13, August 17, 2022 No. 2022-P-33/52-2)

In accordance with Articles 20 and 68 of the Law of the Kyrgyz Republic "On the National Bank of the Kyrgyz Republic, Banks and Banking Activity", Article 15 of the Law of the Kyrgyz Republic "On Guarantee Funds in the Kyrgyz Republic", the Board of the National Bank of the Kyrgyz Republic resolves:

1. Make amendments and changes to the following regulatory legal acts of the National Bank of the Kyrgyz Republic (attached):

• Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Regulation "On Classification of Assets and Corresponding Provisions for Potential Losses and Expenses" dated July 21, 2004 No. 18/3";

• Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Regulation "On Requirements for the Accounting Policy of Commercial Banks and Other Financial and Credit Organizations Licensed by the National Bank of the Kyrgyz Republic" dated October 23, 2004 No. 26/2";

• Resolution of the Board of the National Bank of the Kyrgyz Republic "On Certain Regulatory Legal Acts of the National Bank of the Kyrgyz Republic" dated August 25, 2005 No. 26/5";

• Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Regulation "On Requirements for the Formation of Financial Reporting of Commercial Banks of the Kyrgyz Republic" dated March 12, 2010 No. 6/2";

• (paragraph lost force in accordance with the Resolution of the Board of the National Bank of the Kyrgyz Republic of August 17, 2022 No. 2022-P-33/52-2)

• Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Regulation "On Pre-trial Regulation of Disputes between the National Bank of the Kyrgyz Republic and Commercial Banks, Organizations Carrying Out Certain Types of Banking Operations and Their Founders (Participants), Legal and Physical Persons" dated May 17, 2017 No. 19/13";

• Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Regulation "On Minimum Requirements for External Audit of Banks and Other Financial and Credit Organizations Licensed by the National Bank of the Kyrgyz Republic" dated June 15, 2017 No. 2017-P-12/25-2-(NPA)";

• Resolution of the Board of the National Bank of the Kyrgyz Republic "On the Regulation "On Measures of Impact Applied to Banks and Some Other Financial and Credit Organizations Licensed by the National Bank of the Kyrgyz Republic" dated June 15, 2017 No. 2017-P-12/25-4-(NPA)";

• Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Regulation "On Minimum Requirements for Risk Management in Banks of the Kyrgyz Republic" dated June 15, 2017 No. 2017-P-12/25-8-(NPA)".

2. The Legal Department:

• publish this Resolution on the official website of the National Bank of the Kyrgyz Republic;

• after official publication, send this Resolution to the Ministry of Justice of the Kyrgyz Republic for inclusion in the State Register of Regulatory Legal Acts of the Kyrgyz Republic.

3. This Resolution enters into force after the expiration of fifteen days from the date of official publication.

Guarantee Funds of the Kyrgyz Republic shall bring their activities into compliance with this Resolution within a six-month period from the date of entry into force of this Resolution.

4. The Department for Supervision of Non-Bank Financial and Credit Organizations shall bring this Resolution to the attention of the Guarantee Funds of the Kyrgyz Republic.

5. Control over the implementation of this Resolution shall be entrusted to the Member of the Board of the National Bank of the Kyrgyz Republic, who supervises the Department for Supervision of Non-Bank Financial and Credit Organizations.

Amendments and Changes in Certain Regulatory Legal Acts of the National Bank of the Kyrgyz Republic

1. Make the following addition to the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Regulation "On Classification of Assets and Corresponding Provisions for Potential Losses and Expenses" dated July 21, 2004 No. 18/3":

in the Regulation "On Classification of Assets and Corresponding Provisions for Potential Losses and Expenses", approved by the aforementioned Resolution:

• paragraph 1.1. after the words "State Development Bank of the Kyrgyz Republic" add the words ", guarantee funds".

2. Make the following additions to the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Regulation "On Requirements for the Accounting Policy of Commercial Banks and Other Financial and Credit Organizations Licensed by the National Bank of the Kyrgyz Republic" dated October 23, 2004 No. 26/2":

in the Regulation "On Requirements for the Accounting Policy of Commercial Banks and Other Financial and Credit Organizations Licensed by the National Bank of the Kyrgyz Republic", approved by the aforementioned Resolution:

• the preamble after the words "(hereinafter - FKKS)," add the words "guarantee funds,";

• paragraph 4.1. after the abbreviation "FKKS" add the words ", guarantee funds".

3. Make the following addition to the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Certain Regulatory Legal Acts of the National Bank of the Kyrgyz Republic" dated August 25, 2005 No. 26/5":

in the Regulation "On Periodic Regulatory Banking Report", approved by the aforementioned Resolution:

• paragraph 1.2. after the words "Financial Company of Credit Unions" add the words "and guarantee funds".

4. Make the following addition to the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Regulation "On Requirements for the Formation of Financial Reporting of Commercial Banks of the Kyrgyz Republic" dated March 12, 2010 No. 6/2":

in the Regulation "On Requirements for the Formation of Financial Reporting of Commercial Banks of the Kyrgyz Republic", approved by the aforementioned Resolution:

• paragraph 1 after the words "JSC "Financial Company of Credit Unions," add the words ", guarantee funds".

5. (Lost force in accordance with the Resolution of the Board of the National Bank of the Kyrgyz Republic of August 17, 2022 No. 2022-P-33/52-2)

6. Make the following addition to the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Regulation "On Pre-trial Regulation of Disputes between the National Bank of the Kyrgyz Republic and Commercial Banks, Organizations Carrying Out Certain Types of Banking Operations and Their Founders (Participants), Legal and Physical Persons" dated May 17, 2017 No. 19/13":

in the Regulation "On Pre-trial Regulation of Disputes between the National Bank of the Kyrgyz Republic and Commercial Banks, Organizations Carrying Out Certain Types of Banking Operations and Their Founders (Participants), Legal and Physical Persons", approved by the aforementioned Resolution:

• the first paragraph of the preamble before the words "exchange bureau" add the words "guarantee fund,".

7. Make the following addition to the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Regulation "On Minimum Requirements for External Audit of Banks and Other Financial and Credit Organizations Licensed by the National Bank of the Kyrgyz Republic" dated June 15, 2017 No. 2017-P-12/25-2-(NPA)":

in the Regulation "On Minimum Requirements for External Audit of Banks and Other Financial and Credit Organizations Licensed by the National Bank of the Kyrgyz Republic", approved by the aforementioned Resolution:

• paragraph 1 after the words "State Development Bank of the Kyrgyz Republic" add the words "and guarantee funds".

8. Make the following addition to the Resolution of the Board of the National Bank of the Kyrgyz Republic "On the Regulation "On Measures of Impact Applied to Banks and Some Other Financial and Credit Organizations Licensed by the National Bank of the Kyrgyz Republic" dated June 15, 2017 No. 2017-P-12/25-4-(NPA)":

in the Regulation "On Measures of Impact Applied to Banks and Some Other Financial and Credit Organizations Licensed by the National Bank of the Kyrgyz Republic", approved by the aforementioned Resolution:

• the first paragraph of Chapter 1 after the words "JSC "Financial Company of Credit Unions" add the words ", guarantee funds".

9. Make the following addition to the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Regulation "On Minimum Requirements for Risk Management in Banks of the Kyrgyz Republic" dated June 15, 2017 No. 2017-P-12/25-8-(NPA)":

in the Regulation "On Minimum Requirements for Risk Management in Banks of the Kyrgyz Republic", approved by the aforementioned Resolution:

• paragraph 1 after the words "commercial banks" add the words ", guarantee funds".
