RESOLUTION

dated 4 July 2012 No. 28/9

On Introducing Additions to Certain Regulatory Legal Acts of the National Bank of the Kyrgyz Republic

(as amended by resolution of the Board of the National Bank of the Kyrgyz Republic dated 15 June 2017 No. 2017-П-12/25-12-(НПА)

In accordance with Articles 7 and 43 of the Law of the Kyrgyz Republic "On the National Bank of the Kyrgyz Republic", the Board of the National Bank of the Kyrgyz Republic

RESOLVES:

1. To approve the additions to certain regulatory legal acts of the National Bank of the Kyrgyz Republic (attached).

2. After official publication, the Legal Department shall send this resolution to the Ministry of Justice of the Kyrgyz Republic for inclusion in the State Register of Regulatory Legal Acts of the Kyrgyz Republic.

3. The Supervision and Licensing Methodology Department shall bring this resolution to the attention of the regional departments of the National Bank, commercial banks, microfinance companies, credit unions and exchange bureaus.

4. This resolution enters into force upon the expiry of one month after official publication.

5. Control over the execution of this resolution shall be assigned to the Deputy Chairman of the National Bank of the Kyrgyz Republic Chokoev Z.L.

ADDITIONS to certain regulatory legal acts of the National Bank of the Kyrgyz Republic

I. Repealed in accordance with resolution of the Board of the National Bank of the Kyrgyz Republic dated 15 June 2017 No. 2017-П-12/25-12-(НПА)

II. Repealed in accordance with resolution of the Board of the National Bank of the Kyrgyz Republic dated 15 June 2017 No. 2017-П-12/25-12-(НПА)

III. To introduce into the Instruction on conducting inspections of the activities of credit unions, approved by resolution of the Board of the National Bank of the Kyrgyz Republic No. 13/13 dated 14 March 2007, registered with the Ministry of Justice of the Kyrgyz Republic on 20 April 2007, registration number 44-07, the following addition:

To supplement the Instruction with clause 4.6.-1. reading as follows:

"The management of the CU, when inspections are conducted by the NBKR, shall provide a separate room in the credit union for the NBKR inspection group, in which there are no audio/video devices carrying out audio/video recording, shall suppress any attempts by third parties to install audio/video equipment in the room provided to the NBKR inspection group, shall ensure the security of storage of documents of the credit union and of the NBKR inspection group, and shall also provide the said persons with the equipment and technical means necessary for conducting the inspection.".

IV. To introduce into the Regulation on the procedure for conducting exchange operations with cash foreign currency in the Kyrgyz Republic, approved by resolution of the Board of the National Bank of the Kyrgyz Republic No. 42/1 dated 30 November 2000, registered with the Ministry of Justice of the Kyrgyz Republic on 15 December 2000, registration number 201, the following addition:

To supplement the Regulation with clause 7.3.-1. reading as follows:

"Exchange offices of authorized banks and exchange bureaus, when inspections of their activities are conducted by the NBKR, shall provide a separate room in the exchange office of the authorized bank or exchange bureau for the NBKR inspection group, in which there are no audio/video devices carrying out audio/video recording, shall suppress any attempts by third parties to install audio/video equipment in the room provided to the NBKR inspection group, shall ensure the security of storage of documents of the exchange office of the authorized bank or exchange bureau and of the NBKR inspection group, and shall also provide the NBKR inspection group with the equipment and technical means necessary for conducting the inspection.".
