RESOLUTION

of October 23, 2013 No. 39/6

On Amendments and Additions to the Resolution of the Board of the National Bank of the Kyrgyz Republic No. 37/2 of September 12, 2012 "On Approval of the Instruction on the Provision by Commercial Banks of the Kyrgyz Republic to Clients of Individual Bank Safes for the Storage of Valuables"

In accordance with Articles 7 and 43 of the Law of the Kyrgyz Republic "On the National Bank of the Kyrgyz Republic", the Board of the National Bank of the Kyrgyz Republic

RESOLVES:

1. Approve the attached amendments and additions to the Instruction on the provision by commercial banks of the Kyrgyz Republic to clients of individual bank safes for the storage of valuables, approved by the Resolution of the Board of the National Bank of the Kyrgyz Republic No. 37/2 of September 12, 2012.

2. To the Legal Department:

• publish this resolution on the official website of the National Bank of the Kyrgyz Republic;

• after official publication, send this resolution to the Ministry of Justice of the Kyrgyz Republic for inclusion in the State Register of Regulatory Legal Acts of the Kyrgyz Republic.

3. The Supervision and Licensing Methodology Department to bring this resolution to the attention of commercial banks.

4. This resolution enters into force upon the expiration of one month after its official publication.

5. Control over the implementation of this resolution is assigned to the Deputy Chairman of the National Bank of the Kyrgyz Republic Z.L. Chokoev.

AMENDMENTS AND ADDITIONS to the Resolution of the Board of the National Bank of the Kyrgyz Republic No. 37/2 of September 12, 2012 "On Approval of the Instruction on the Provision by Commercial Banks of the Kyrgyz Republic to Clients of Individual Bank Safes for the Storage of Valuables"

Make the following amendments and additions to the Instruction on the provision by commercial banks of the Kyrgyz Republic to clients of individual bank safes for the storage of valuables, approved by the Resolution of the Board of the National Bank of the Kyrgyz Republic No. 37/2 of September 12, 2012:

1. Supplement Paragraph 6 with a new paragraph of the following content:

"Note. For storage contracts concluded before the entry into force of this Instruction and currently in effect, the bank must obtain information on the full name of the beneficial owner (beneficiary), as well as a copy of the document certifying the identity of the beneficial owner (beneficiary), if he is not a client."

2. In the first sentence of the first paragraph of Paragraph 10, replace the words "Preliminarily, before concluding a storage contract between the bank and the client, the bank" with the words "The bank,".

3. Redraft Paragraph 22 as follows:

"22. If the bank's safe is equipped with a lock on 1 mechanical key, which is transferred to the client, then the bank must replace this lock every time after the client returns the safe."

4. In the second paragraph of Paragraph 28, replace the words "a member of the bank's board, authorized according to the bank's internal documents to supervise issues related to the provision of safes to clients for storage" with the words "head of the bank's department/branch, in which the opening, search, or seizure of items stored in the safe, as well as the imposition of a seizure on these items, is carried out".

5. In Paragraph 33, replace the words "Board of the bank" with the words "Board of the bank or the person authorized to supervise issues related to the provision of safes to clients for storage,".
