Resolution of the Board of the National Bank of the Republic of Kazakhstan No. 65 on Amendments to Resolution No. 242 on Approval of Rules for Establishing the Official Exchange Rate of the National Currency

On Amendments to the Resolution of the Board of the National Bank of the Republic of Kazakhstan dated August 24, 2012 No. 242 "On Approval of the Rules for Establishing the Official Exchange Rate of the National Currency of the Republic of Kazakhstan to Foreign Currencies"

The Board of the National Bank of the Republic of Kazakhstan RESOLVES:

1. Make the following amendments to the Resolution of the Board of the National Bank of the Republic of Kazakhstan dated August 24, 2012 No. 242 "On Approval of the Rules for Establishing the Official Exchange Rate of the National Currency of the Republic of Kazakhstan to Foreign Currencies" (registered in the Registry of State Registration of Normative Legal Acts under No. 7977):

rephrase the preamble as follows:

"In accordance with subparagraph 5) of paragraph 2 of Article 15 of the Law of the Republic of Kazakhstan "On the National Bank of the Republic of Kazakhstan" and subparagraph 2) of the second paragraph of part two of paragraph 19 of the Regulation on the National Bank of the Republic of Kazakhstan, approved by the Decree of the President of the Republic of Kazakhstan dated December 31, 2003 No. 1271 "On Approval of the Regulation and Structure of the National Bank of the Republic of Kazakhstan", the Board of the National Bank of the Republic of Kazakhstan RESOLVES:";

in the Rules for establishing the official exchange rate of the national currency of the Republic of Kazakhstan to foreign currencies, approved by the said resolution:

rephrase the preamble as follows:

"These Rules for establishing the official exchange rate of the national currency of the Republic of Kazakhstan to foreign currencies (hereinafter - the Rules) are developed in accordance with subparagraph 5) of paragraph 2 of Article 15 of the Law of the Republic of Kazakhstan "On the National Bank of the Republic of Kazakhstan" and subparagraph 2) of the second paragraph of part two of paragraph 19 of the Regulation on the National Bank of the Republic of Kazakhstan, approved by the Decree of the President of the Republic of Kazakhstan dated December 31, 2003 No. 1271 "On Approval of the Regulation and Structure of the National Bank of the Republic of Kazakhstan" and determine the procedure for establishing by the National Bank of the Republic of Kazakhstan (hereinafter - the National Bank) the official exchange rate of the national currency of the Republic of Kazakhstan to foreign currencies.";

in paragraph 1:

rephrase subparagraph 1) as follows:

"1) ACS - automated digital systems of the National Bank;";

rephrase subparagraph 5) as follows:

"5) official exchange rate of the national currency - the exchange rate of the tenge established by the National Bank in relation to foreign currencies in accordance with the appendix to the Rules. The procedure for establishing the official exchange rate of the national currency to foreign currencies is analogous to the procedure for determining the market exchange rate of currencies. The purposes of using the official exchange rate of the national currency and the market exchange rate of currencies are established by the Tax Code of the Republic of Kazakhstan, the Code of the Republic of Kazakhstan "On Customs Regulation in the Republic of Kazakhstan", the Law of the Republic of Kazakhstan "On the National Bank of the Republic of Kazakhstan" and international agreements of the Republic of Kazakhstan.";

rephrase paragraphs 3 and 4 as follows:

"3. The weighted average exchange rate of the national currency to the US dollar, formed as of 15:30 Astana time, is established as the official exchange rate of the national currency to the US dollar for the next working day after the day of trading.

4. For other foreign currencies specified in the appendix to the Rules, the exchange rate of the national currency in relation to the foreign currency is calculated by the National Bank using the cross-rate to the US dollar, formed in accordance with demand quotes received via the information agency channels as of 16:00 Astana time on the day of trading at the stock exchange and is established as the official exchange rate for the next working day.";

rephrase the second part of paragraph 6 as follows:

"If, when calculating, the official exchange rate of a foreign currency in relation to the tenge is less than one, the numerical value of the nominal value of the foreign currency is changed by increasing it to the required value.";

rephrase paragraphs 10 and 11 as follows:

"10. The document on official exchange rates of foreign currencies to the national currency on the day of its signing until 18:00 Astana time is brought to the attention of the subdivisions of the National Bank, second-level banks, and other interested organizations by transmitting data through official communication channels (interbank information transfer and payment system (SWIFT)) and e-mail.

11. Information on the official exchange rate of the national currency to foreign currencies (official exchange rates of foreign currencies to the national currency) is entered into the AIS on the day of establishment until 24:00 Astana time.";

rephrase the appendix in the edition according to the appendix to this resolution.

2. The Monetary Operations Department of the National Bank of the Republic of Kazakhstan shall ensure in the manner established by the legislation of the Republic of Kazakhstan:

1. jointly with the Legal Department of the National Bank of the Republic of Kazakhstan the state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;

2. placement of this resolution on the official Internet resource of the National Bank of the Republic of Kazakhstan after its official publication;

3. within ten working days after the state registration of this resolution, submission to the Legal Department of the National Bank of the Republic of Kazakhstan of information on the implementation of measures provided for in subparagraph 2) of this paragraph.

3. Control over the implementation of this resolution shall be entrusted to the Deputy Chairman of the National Bank of the Republic of Kazakhstan in charge.

4. This resolution shall enter into force upon the expiration of ten calendar days after the day of its first official publication, except for the eighth and ninth paragraphs of paragraph 1 of this resolution, which shall enter into force from July 12, 2026.

It is established that from July 12, 2026, the nineteenth paragraph of paragraph 1 of this resolution shall operate in the following edition:

"11. Information on the official exchange rate of the national currency to foreign currencies (official exchange rates of foreign currencies to the national currency) is entered into the ACS on the day of establishment until 24:00 Astana time.".
