The application by Arthur Do Nascimento Silva and Álvaro Eduardo Gálvez Fernández to organize Zest Capital Sociedad Administradora de Fondos de Inversión S.A.C. is denied. The organizers, who would hold 56% and 44% of the share capital, failed to demonstrate the economic solvency required by articles 4 and 5 of the Common Rules, including the S/ 1 829 994.00 minimum capital for 2024, and did not remedy an observation regarding their sworn declarations under Annex B. A related company, Zest Capital Perú S.A.C., was previously sanctioned for two very serious infractions.

For this purpose, special attention must be paid to the liquid assets, or eventually to the easily liquidated assets, held by the ORGANIZERS;
That, likewise, for the purposes of the solvency evaluation, existing resources are considered, such as the balances of cash resources available in bank accounts and the value of other assets, as well as existing liabilities;

That, it is necessary to point out that in the Sworn Declaration of Origin of Funds, the ORGANIZERS have stated that the funds for the incorporation of ZEST SAFI will come from income derived from the assets described in the Sworn Declaration of Patrimonial Assets. In this regard, it should be noted that such funds can only be accredited through cash resources in bank accounts and other current assets, which have been considered to determine the position of net liquid assets;
