Resolution of the General Intendancy of Supervision of Entities

The General Intendant of Supervision of Entities

WHEREAS:

File No. 2024036882 initiated by Autoplan Empresa Administradora de Fondos Colectivos S.A., as well as Report No. 1242-2024-SMV/10.2 dated 23 September 2024 from the General Intendancy of Supervision of Entities;

CONSIDERING:

That, by Resolution of the General Intendancy of Supervision of Entities No. 092-2017-SMV/10.2 dated 20 June 2017, the collective funds program called "Plan 21" was authorized, as well as its respective contract model to be used by Autoplan Empresa Administradora de Fondos Colectivos S.A. for its administration, and its registration in the Special Registry of Other Entities under the competence of the Superintendency of the Securities Market was ordered;

That, by writings submitted up to 20 September 2024, Autoplan Empresa Administradora de Fondos Colectivos S.A. requested authorization for the modification of the collective funds administration contract used in the management of the "Plan 21" program;

That, from the evaluation of the documentation submitted, it has been determined that Autoplan Empresa Administradora de Fondos Colectivos S.A. has complied with: (i) the provisions of article 30 of the Regulation of the Collective Funds System and its Administrating Companies; (ii) the Single Text of Administrative Procedures of the Superintendency of the Securities Market, for the authorization of the modifications of the contract used in the "Plan 21" program, as well as for its registration in the Special Registry of Other Entities under the competence of the SMV, as developed in Report No. 1242-2024-SMV/10.2; and,

In accordance with the provisions of article 38, numeral 5, subparagraphs ix) and x) of the Regulation of Organization and Functions of the Superintendency of the Securities Market.

RESOLVES:

Article 1.- Approve the modifications of the administration contract used in the "Plan 21" program used by Autoplan Empresa Administradora de Fondos Colectivos S.A. in the management of the referred program and order its registration in the Special Registry of Other Entities under the competence of the Superintendency of the Securities Market.

Article 2.- The modifications referred to in the preceding article shall enter into force on the business day following the communication indicated in the last paragraph of article 32 of the Regulation of the Collective Funds System and its Administrating Companies.

Article 3.- The modifications referred to in article 1 of this resolution shall be applicable to the groups formed after its entry into force.

Article 4.- Order the dissemination of this resolution on the Securities Market Portal of the Superintendency of the Securities Market (www.gob.pe/smv).

Article 5.- Transcribe this resolution to Autoplan Empresa Administradora de Fondos Colectivos S.A
