SBS Resolution No. 123-2005: Removes Annex No. 6 of Form E from Chapter V "Annexes and Reports" of the Accounting Manual, and provides that Annexes 1 and 4 of said Form E must be submitted only to the Central Reserve Bank of Peru

The Superintendent of Banking and Insurance

WHEREAS:

That, by SBS Resolution No. 895-98 of September 1, 1998 and its amendments, the Accounting Manual for Companies of the Financial System, hereinafter the Accounting Manual, was approved;

That, by SBS Circular No. B-2084-2001 and F-424-2001 of January 5, 2001, the Advance Information of the Balance Sheet and Annexes No. 4 and No. 6 of Form "E" were adapted to the Accounting Manual, which form part of Chapter V "Annexes and Reports to the Financial Statements" of said Manual;

That, the first paragraph of the First Final and Complementary Provision of the General Law of the Financial System and the Insurance System and Organic Law of the Superintendency of Banking and Insurance, Law No. 26702 and its amendments, hereinafter the General Law, states that the Central Reserve Bank of Peru and the Superintendency of Banking and Insurance must make the pertinent coordinations in order to comply with the purposes entrusted to them by the Political Constitution of Peru;

That, in accordance with the coordinations made with the Central Reserve Bank of Peru and in order to achieve a better supervision and analysis work by this Control Body, as well as to optimize the use of the information provided by the companies of the financial system, it has been considered convenient to cease requiring Annex No. 6 of Form "E" and to modify the addressee of Annexes No. 1 and No. 4 of Form "E", as well as of Annex No. 20 "Balance Sheet Segmented by Economic Agents";

In accordance with the opinion of the Deputy Superintendencies of Banking, Legal Advisory and Risk, as well as of the Economic Studies Management; and,

In use of the powers conferred by numerals 9 and 13 of article 349 of the General Law;

RESOLVES:

Article One.- Remove from Chapter V "Annexes and Reports" of the Accounting Manual, Annex No. 6 "Advance Information of the Balance Sheet at Historical Values" of Form E.

Article Two.- The Annexes of Form E: No. 1 "Segmentation of the Main Balance Sheet Items" and "List of Economic Agents", and No. 4 "Advance Information of Income and Expenses", must be submitted only to the Central Reserve Bank of Peru, at the time and within the deadlines indicated in Circular B-2084-2001 and F-0424-2001.

Article Three.- Annex No. 20 "Balance Sheet Segmented by Economic Agents" shall be submitted only to the Central Reserve Bank of Peru, at the time and within the deadlines indicated in the Accounting Manual.

Article Four.- This Resolution shall enter into force as of the information corresponding to the month of January 2005. Likewise, as of the entry into force of this rule, all provisions that oppose it in whole or in part are repealed.
