S.B.S. Resolution No. 1259-2020 The Superintendent of Banking, Insurance and Private Pension Fund Administrators:

WHEREAS:

That, by Supreme Decree No. 008-2020-SA, of last 11 March, a “Health Emergency” was declared at the national level, for a period of ninety (90) calendar days, due to the existence of COVID-19;

That, by Supreme Decree No. 044-2020-PCM of 15 March, a “National State of Emergency” was declared for fifteen calendar days, due to the serious circumstances affecting the life of the Nation as a consequence of the COVID-19 outbreak; and, through Urgency Decree No. 026-2020, of the same date, additional extraordinary measures have been approved to allow preventive and response actions to be adopted to reduce the risk of spread of said virus;

That, in its article 3, Supreme Decree No. 044-2020-PCM has provided for the restriction of the exercise of constitutional rights relating to personal liberty and security, the inviolability of the home, and freedom of assembly and transit, included in article 2 of the Political Constitution of Peru;

That, the Second Final Complementary Provision of Urgency Decree No. 026-2020 establishes that, within the framework of the State of Emergency declared by Supreme Decree No. 008-2020-SA, constitutionally autonomous bodies, such as this Superintendency, shall order the suspension of the terms they consider necessary in order not to harm citizens or the performance of their functions;

That, within the scope of competence of this Superintendency are the companies, entities and natural persons forming part of the financial, insurance, private pension systems, savings and credit cooperatives not authorized to take deposits from the public, derramas, cajas de beneficios, AFOCAT, persons under the scope of Law No. 27653 and its amendments and others incorporated by express rule into its competence;

In accordance with the provisions established in the rules cited in the preceding recitals, and in use of the powers conferred in literals 2 and 11 of article 367 of Law No. 26702, General Law of the Financial System and the Insurance System and Organic Law of the Superintendency of Banking and Insurance;

RESOLVES:

Article One.- To suspend, for 15 calendar days, the computation of administrative terms related to the functions and powers corresponding to this Superintendency, within the framework of the provisions of the Recitals of this resolution.

Article Two.- The provisions of the preceding article also include the terms legally established for the delivery of information requested from this Superintendency virtually, as well as the terms referred to in articles 252 and 253 of the Single Ordered Text of Law No. 27444.

Article Three.- By multiple official letters, signed by the competent Deputy Superintendents, the measures, complementary instructions and exceptions applicable to the systems supervised by this Superintendency shall be established, as necessary for the implementation of the provisions of this resolution.

Article Four.- This resolution is published on the Institutional Portal (www.sbs.gob.pe).
