Scherbel v. Salt Lake City
The Supreme Court of Utah affirmed the dismissal of Jack Scherbel's complaint challenging Salt Lake City's denial of zoning approval for his condominium project. The court held that under the city's council-mayor form of government, the City Council lacked authority to hear zoning appeals because such functions are executive, not legislative, and must instead be handled by the Board of Adjustment. Additionally, the court ruled that Scherbel had no vested rights to the original zoning classification because his applications were incomplete and the proposed zoning changes were already pending at the time of filing.
