Rule · BCRA · 22 Oct 2026 · A 8497
From 01/11/26, financial institutions and payment service providers offering payment accounts must, when offering money market funds, disclose across all digital media the 7-calendar-day unit share value variation as an annual nominal rate net of administration and custody fees, plus fund identifying data, next to the investment option. Financial institutions acting as managers, custodians, placement agents or promoters must state unit shares are not deposits and cannot guarantee capital value, performance, redemption value or liquidity, except for term investments ensuring capital maintenance. They must display this in advertising, documentation and premises, and report holders' tax status to ARCA via CUIT.

SINAP 1-258:

“1- To provide, with effect from 01/11/26, that financial institutions and payment service providers that offer payment accounts, when they make available to their clients the operation with money market funds, must inform them through all their digital media where that service is presented (Internet banking –home banking–, mobile banking applications, interoperable digital wallets, etc.) of the variation in the value of the unit share over the last 7 (seven) calendar days expressed as an annual nominal rate –net of administration and custody fees–, as well as the identifying data of such funds, their description and class of unit share.
Access to the aforementioned information must be easy and direct, in terms of visibility and size, on those media, located next to the investment option and where the performance of such fund is reported.

Financial institutions may act as intermediaries –whether as negotiation agent and/or settlement and clearing agent (integral or proprietary)– in transactions with other instruments of the funds. These operations must be completed on the same day, so that at the daily close the values involved are not recorded as holdings.
The established limitations must be observed on an individual and consolidated basis.
For the purposes of calculation on a consolidated basis, holdings of unit shares recorded by non-financial companies that must consolidate information with the financial institution are excluded from the computation, provided that in the transactions they have used resources from their own business that –directly or indirectly– have not been provided to make the acquisition by the controlling entity.
Financial institutions that, directly or indirectly, act as managers, custodians, placement agents or promoters of mutual investment funds must inform interested parties that the unit shares of the funds do not constitute deposits in the intervening financial institution, which is also prevented from assuming any commitment that implies guaranteeing, at any time, the maintenance of the value of the invested capital, its performance, the redemption value of the unit shares or granting liquidity for that purpose.
In addition, when they make available to their clients the operation with money market funds, they must inform them through all their digital media where that service is presented (Internet banking –home banking–, mobile banking applications, interoperable digital wallets, etc.) of the variation in the value of the unit share over the last 7 calendar days expressed as an annual nominal rate –net of administration and custody fees–, as well as the identifying data of such funds, their description and class of unit share. Access to the aforementioned information must be easy and direct, in terms of visibility and size, on those media, located next to the investment option and where the performance of such fund is reported.
In cases where the resources of a fund are placed in term investments in accordance with current regulations that contemplate the possibility of ensuring the maintenance of the capital value, or where options with the same effect have been directly sold to the fund, whatever the intervening entity, the prohibition in the matter referred to in point 7.3.1.1 shall not apply.
The participating financial entities shall expressly state the aspects mentioned in point 7.3.1.1. in graphic advertising carried out through any medium and in the documentation (subscription applications and account statements detailing holdings of units) related to the placements made.
It must also be displayed in all premises of the participating entities where units of the funds are promoted and/or sold.
In a legible and prominent form, the following text shall be used:
“Investments in units of the Fund do not constitute deposits in .................... (name of the participating financial entity) for the purposes of the Financial Entities Law nor do they have any of the guarantees that such demand or time deposits may enjoy in accordance with the legislation and regulations applicable to deposits in financial entities. Likewise, ................. (name of the participating financial entity) is prevented by rules of the Central Bank of the Argentine Republic from assuming, tacitly or expressly, any commitment as to the maintenance, at any time, of the value of the invested capital, the yield, the redemption value of the units or the granting of liquidity for such purpose.”
At the time of carrying out the first transaction, natural persons who are holders or in whose name a transaction is registered, legal representatives of legal persons, etc. shall use any of the documents provided for in the Consolidated Text on Valid Identification Documents.
Legal or natural persons who are holders or in whose name an account or transaction is registered, legal representatives, etc. shall report their status to the Agency of Revenue and Customs Control (ARCA) by providing the corresponding element, as indicated below:
7.4.2.1. Unique tax identification key (CUIT).
7.4.2.2. Unique labor identification code (CUIL).
7.4.2.3. Identification key (CDI). The financial entities participating in the transaction shall manage compliance with this requirement through the process generated for such purposes by ARCA.
